A residence permit is granted for a period of up to 5 years, but the validity period of the card, depending on the basis on which it was issued, ranges from 1 to 3 years. Thus, the card must be renewed. To avoid problems with renewal, the card holder is advised to take care of the procedure in advance. To extend the visa, you need to collect documents that are intended to confirm the existence of grounds for further stay in the country, and then submit an application.

Possible reasons for refusal to issue

A negative decision on a foreigner’s application occurs if the applicant fails to comply with the requirements for the procedure or if he does not meet the established requirements for applicants. Cards are also denied to applicants who provide false information.

Modern Slovakia is a small state with a dynamically developing economy and the lowest crime rate in Europe. Eleven years ago, it joined the ranks of the European Union member states, becoming especially attractive for those who plan to start a new, more comfortable life as a European citizen.

Having long been hidden in the shadow of the industrial Czech Republic and having spent 15 years on market reforms, today's Slovakia finds itself in 36th place in the WGEO world ranking of living standards. And even if it is not yet the “brightest” among the EU countries, it is certainly no less prosperous and comfortable for life. Moreover, Slovakia is one of a small number of European countries that not only “meet halfway” to potential immigrants, but also try to save them money and time.

Pitfalls of residence permit

Many citizens of Russia, Ukraine, and CIS countries want to move to live abroad - scammers skillfully take advantage of this. In Slovakia, like mushrooms after rain, companies that issue residence permits are appearing. The excess of non-professional organizers of residence permits leads to an increase in the number of refusals by authorities to obtain and renew a residence permit in Slovakia.

Among the organizers of residence permits, the majority are now guys from Ukraine. They live in Slovakia for 1-3 years. They did not find profitable work for themselves. The only thing they know is how the residence permit was obtained for them. This is what they do themselves. It is difficult to make money from Slovaks; they make money from inexperienced fellow countrymen and Russian-speaking foreigners.

For this purpose, many Internet sites and YouTube video channels have been created. They give various supposedly useful advice on life in Slovakia. They lure compatriots from Ukraine, citizens of Russia and CIS countries to Slovakia.

They attract with low prices and bonuses for establishing a company or individual entrepreneur and obtaining a residence permit. They “forget” to say that the first payment is only an advance. The main amounts are extracted from clients after paying an advance during the procedure for obtaining a residence permit. It is impossible to return the advance payment. Clients are forced to comply so as not to lose the money they have already given. As a result, the final cost of a residence permit grows to several thousand, and a residence permit is often not obtained.

The organizers of the residence permit themselves do not speak the Slovak language well, do not have Slovak lawyers, do not know the laws, all the intricacies of obtaining and renewing a residence permit, or how to appeal the decisions of the authorities that did not issue or renew the residence permit. They don’t know how to act when some authorities don’t want to issue the certificates needed to renew a residence permit.

In Slovakia there are several companies with Russian and Ukrainian founders who are seriously involved in organizing residence permits and comply with the laws. These companies do not hide their names and surnames of employees. All foreigners living in Slovakia know them.

But even more than other companies. Their websites do not contain the true name of the company and the names of the employees are not indicated. Only e-mail, phone number and contact window are indicated. Serious companies that help obtain residence permits always publish the names and photographs of employees on their websites. If there are no names and photographs, site owners have something to hide. Such sites are created not only by non-professionals who want to make easy money from inexperienced compatriots. Behind these sites there may be criminals who issue illegal residence permits and citizenships and engage in illegal migration.

1. Criminal Code of Slovakia on illegal residence permit

In the Slovak Criminal Code, obtaining or assisting in obtaining an illegal residence permit or illegal work in the Slovak Republic and another EU state for oneself or for another person with the aim of obtaining financial or other benefits is regarded as aiding illegal residence and illegal work in the territory of the Slovak Republic and the European Union. Organizers of illegal residence permits are punishable by imprisonment for a term of two to eight years.

Criminal Code of the Slovak Republic, Law No. 300/2005, § 356 (Zákon č. 300/2005 Z. z.

The data of illegal migrants is entered into a single database of persons undesirable for the European Union, against which all those entering the EU are checked at border crossings.

We advise you to do the residence permit honestly, i.e. have real housing, purchased or rented, and the necessary money. If you organize a residence permit in an illegal way, you risk losing your last money and losing the right to visit the EU for years. Your data will be entered into a single database of persons undesirable for the EU, against which all those entering the EU are checked at border crossings.

If you don’t have money, it’s better not to immigrate to Europe - there will be more problems here than at home.

2. Warning to foreign police

There is a notice board in front of the Foreign Police building in Bratislava. It publishes cases of foreigners who were not given or who were deprived of a residence permit. These are mainly citizens of Ukraine. Reasons are given why they were not allowed to live and work in Slovakia. This information is published for prevention purposes - to prevent other foreigners from deceiving and providing false information. The names of intermediaries and the names of intermediary companies that provide residence permits illegally are published in the papers on the board. Lawsuits have been filed against some.

But foreigners don’t read this message board, and that’s in vain. Useful information is published on the board that will help you not repeat the mistakes of unsuccessful residence permit applicants.

3. Illegal transfers

One example of the production of false certificates was the case of a translator who put fake stamps on translations of certificates from Russian-speaking foreigners.

The TAZ news channel showed this report. Hundreds of Russians are facing eviction from Slovakia due to a false translator's seal.

Because of the activities of this translator, several dozen Russian families were not given a residence permit.

You need to be careful with offers of cheap court translations on the Internet.

4. How to check the organizer of a residence permit

If the organizer of a residence permit does not himself have permanent residence or citizenship of Slovakia, it is a big question whether he will renew his residence permit for the next period and whether he himself will ever be able to obtain permanent residence and citizenship of Slovakia. Nevertheless, the residence permit is for others; you have to live on something.

A simple way to check the competence of the residence permit organizer is to ask him to show his Slovak internal passport (in Slovak: “občiansky preukaz”). You have the right to this, you pay a lot of money for a residence permit. If the organizer does not have a Slovak passport, let him show his permanent residence card (in Slovak: “povolenie na trvalý pobyt”). If he does not have this document, it means he was unable to obtain permanent residence or citizenship for himself. It won't do it for you either.

The main problems for a new residence permit holder will begin after receiving a residence permit card. There are no Slovak companies cooperating with his company, there is no honest accounting. All the money was given to the organizer of the residence permit. It is impossible to return them back. Such residence permit holders in Slovakia cannot survive more than a year on false certificates, without real money, real estate to live in and proper accounting.

A year later, the police check the residence permit holder more thoroughly, requiring him to provide a certificate of income from his company, the absence of debts to tax, social and insurance institutions, customs, and proof of residence.

Many residence permit organizers sell TNZ. “registration”. These are apartments at the address of which a residence permit is issued, but the holders of the residence permit do not live in them. Such apartments are called “rubber”. It happens that dozens of foreign families are assigned to a rubber apartment with 2 rooms.

All “rubber” apartments are currently registered in the police database. To prevent new rubber apartments from appearing, the police send copies of the official permit for a residence permit to the Slovak Embassy in the country of the residence permit holder, the regional administration and the local government of the district and city in which the foreigner is given the residence permit. lives. Local officials should know which foreigners live with them and inform the police if they do not. This work is also beneficial for officials, since it identifies landlords who do not pay rental taxes to city governments.

We advise you not to buy fake registrations. Their purchase will result in the deprivation of a residence permit.

Tnz. “rubber” apartments and addresses for individual entrepreneurs (PE), in which dozens of immigrant families live in several rooms and dozens of individual entrepreneurs (PE), are registered by the police in their database.

The foreign police decided to put an end to the fictitious business. When renewing a residence permit, the police now invite a foreigner for an interview or come to him without warning. The interview lasts 1-3 hours. At the interview, the foreigner must show invoices and contracts of his company with Slovak companies - specifically with Slovak ones.

Some accountants “circulate” fictitious invoices between their companies for their Russian-speaking clients. In reality, goods are not sold and services are not provided using these invoices. Foreign police know this trick. He can easily find out from the invoices that transactions between each other are carried out by foreigners from the same country. Their companies or individual entrepreneurs, names and countries of permanent residence are in the publicly accessible trade register and real estate cadastre on the Internet. According to Law 404/2011 on the residence of foreigners, updated in 2021, the police now have the right to check the turnover in the bank accounts of foreigners if there is a suspicion that they do not conduct a real business in Slovakia. Those. they do not fulfill the purpose of obtaining a residence permit - entrepreneurship.

When the police, when renewing a residence permit, again receive fake certificates from a foreigner indicating that he has real estate for residence, an operating company, or fictitious profits, he will not renew his residence permit for the next period and will be forced to leave Slovakia.

We cooperate with honest organizers of residence permits. We do not maintain contact with scammers.

5. Freshly minted realtors

Illegal realtors create problems for those wishing to buy real estate in Slovakia. These are mainly immigrants from other countries. We recently arrived in Slovakia. They couldn’t do business for their companies and individual entrepreneurs. They are trying to make money on real estate.

In Slovakia, just anyone has the right to engage in real estate. Real estate is not a free, but a closed entrepreneurial activity. The requirements for it are established by Law 455/1991 on individual entrepreneurship.

In the objects of activity of a company or individual entrepreneur in the trade register https://www.orsr.sk/ there must be an entry: “Sprostredkovanie predaja, prenájmu a kúpy nehnuteľností (realitná činnosť).” Translation: “Intermediation in the sale, rental and purchase of real estate (real estate activities).”

If the intermediary does not have this subject of activity, then you are dealing with a fictitious realtor. He has no right to accept payment for his service. It works “black and white”. His services can cause problems for the buyer and tenant of the property. Mediation in the sale and rental of real estate can only be carried out by legal realtors with an appropriate entry in the commercial register.

By the name of the company or the name of the intermediary, you can check whether the realtor is working legally.

6. Unreliable partners in the company of the residence permit holder

Conflicts between the founders (owners) of the company may interfere with the extension of a residence permit and obtaining permanent residence. When the founders of a company are members of the same family, conflicts between them are rare. When the founders are not related, quarrels between them happen quite often. The reason is monetary disagreements, the reluctance of one of the founders to sign documents with a notary to remove him from the company, quarrels on personal or business grounds, misunderstanding, etc.

In this case, the founder of the company, who wants to continue the residence permit, actually becomes a hostage of his partner. Without interaction with him, he cannot manage the company, remove the partner from the company, make the necessary profit and renew the residence permit.

Be attentive to the partner with whom you are establishing a company and obtaining a residence permit. If you assume that you cannot maintain friendly relations for 5 years, it is better to establish a company alone and obtain a residence permit for yourself and your family.

7. What can happen with a residence permit in Slovakia

The organizers of the residence permit are colloquially called “helpers.” There are already more people who help with residence permits than there are people who want to obtain a residence permit. Therefore, the competition between helpers is fierce; there is a lot of unprofessionalism and lies in their activities.

If in other areas of activity competition leads to an increase in quality and a decrease in the price of the final product, in a residence permit everything happens the other way around. The number of unprofessionals and dishonest methods of obtaining a residence permit is increasing.

Slovakia is a very tempting country to live in. But she keeps her territory from problematic foreigners. For example, it does not provide political asylum. Due to the increasing number of foreigners who deceive the state, legislators will be forced to introduce a more complex method of obtaining a residence permit, adopted in Western European countries. A residence permit will be given for a large investment in the country’s economy or for the purchase of a large package of government bonds. In Western Europe, a residence permit usually requires an investment of at least half a million euros. Plus, fulfilling many difficult conditions for a residence permit applicant. For example, knowledge of the language of the country of residence. This condition is already in force in Hungary and the Czech Republic.

The main reasons for not providing a residence permit are fictitious or incorrectly prepared certificates and documents, as well as the lack of new documents that became necessary after the last update of Law 404/2011 on the residence of foreigners.

Immigration policy of Slovakia

Striving to grow to the level of the “European old-timers” - Austria, Germany - Slovakia is at the stage of actively attracting investments and qualified personnel. This means that the country’s leadership welcomes and creates the necessary conditions for potential immigrants who intend to legally work for the benefit of themselves and their new homeland. Therefore, for example, the costs of processing documents for immigration to Slovakia are the lowest among all EU states, and an ID card can be obtained in just 2 months.

Of course, Slovakia’s advantages are not limited to loyal immigration laws. In addition, holders of a residence permit or citizenship of Slovakia have a number of other advantages:

  • Freedom of movement within the countries of the European Community;
  • The fastest and most economical legalization scheme in Europe;
  • There are no requirements for the length of stay in the country to renew a residence permit;
  • There are still relatively few foreigners in Slovakia;
  • Low level of bureaucracy;
  • Low interest rates on loans and mortgages (as throughout Europe);
  • Possibility of purchasing real estate (including land) for an individual;
  • European education for children (although diplomas and certificates from Ukrainian and Russian schools and universities are recognized in Slovakia).

The first thing that gives access to these benefits on a long-term basis is a residence permit in Slovakia.

Why Slovakia?

Based on the experience of communicating with our clients who have already successfully migrated to the EU, we can talk about many reasons why they choose Slovakia to obtain a residence permit.
Firstly, Russian-speaking migrants are treated well here, they respect and understand the Slavic mentality. At the same time, there are almost no refugees from Middle Eastern or African countries in Slovakia. Mostly people with professions and ambitions migrate here to Slovakia, so migrants here are treated with respect and even interest.

Slovakia will provide the financial comfort of European life for emigrants from the CIS even with a small income (at first after moving). A visit to a Slovak cafe will definitely not be a luxury for you and will not hit your wallet, which cannot be said, for example, about dinner in Germany. Affordable prices for renting housing and purchasing real estate is another plus in favor of Slovakia.

Slovakia is a country with stunning nature (mountains, lakes, forests, mineral waters) and a mild climate , the so-called “Little Switzerland”.

The central square in Banska Bystrica. Having received a residence permit in Slovakia, you will be able to enjoy your time here, as well as anywhere in the EU, without restrictions and visas The central square of the START (Slovak National Uprising) in Banska Bystrica pleases the eye with the architecture of a European city, and summer cafes attract the comfort of a leisurely life. Living in Slovakia with a residence permit, you will have complete
freedom of movement throughout the European Union .
Interesting things are always nearby. Living in Slovakia, taking your child to an Austrian school, and on weekends going for a swim at Lake Balaton in Hungary - here it’s easy and real! Life in Slovakia is calm and measured, the atmosphere is peaceful. Like other Slavs, Slovaks love and know how to celebrate, respect feasts, but at the same time they are massively passionate about sports. If you live in Slovakia, you will definitely be imbued with the spirit of a healthy lifestyle and sports hobbies , here they are for every taste: bicycles (organized bike paths and cycling routes), roller skates, “Nordic” walking, mountain biking, rafting, skiing, football, hockey.

Slovakia has affordable insurance medicine , well-qualified medical staff and medical institutions with modern equipment. Here they treat patients carefully (for example, prescriptions and prescriptions are provided only in printed form, whereas in Russia they are still written by hand, in an incomprehensible handwriting).

And, if you have children, then you will be especially pleased with the free education in Slovakia, both for preschoolers and students.

Residence permit in Slovakia

A residence permit in Slovakia is issued for a period of 1 year, with the possibility of further extension. After 5 years of permanent residence in the country with the status of a residence permit, you can apply for the first permanent residence, and subsequently for citizenship.

The grounds for obtaining a residence permit, according to § 21, paragraph 1 of Law No. 404/2011 Coll. laws of Slovakia dated October 21, 2011 about the stay of foreigners may be:

  • entrepreneurial activity
    (business registered in the Trade Register of Slovakia);
  • permanent or seasonal employment
    ;
  • full-time education
    ;
  • certain types of activities
    - lecturing, sports, cultural, volunteer, providing medical care, internship, etc.;
  • research work
    ;
  • family reunification
    ;
  • belonging to ethnic Slovaks living abroad
    ;
  • based on the EU Blue Card
    (usually issued to highly qualified specialists).

Note:

purchasing real estate in Slovakia is NOT grounds for obtaining residence permit status.

Purposes of entry

The provision of a residence permit is carried out if one of the conditions serving as the basis for its issuance is met. Depending on the purpose of entry, applicants are subject to various requirements (for example, employment, admission to an educational institution, etc.). Accordingly, the procedure for obtaining a residence permit and the list of documents to be submitted will differ to some extent.

Entrepreneurship

The Slovak Republic is characterized as a state in which a comfortable business climate has been created, so relocation to conduct business is a common reason. But it must be taken into account that in order to be granted an entrepreneurial residence permit, the applicant must prove the benefits that the implementation of his business project will provide for the country’s economy.

Important! The process involves submitting a business plan to the Ministry of Economy for review. Launching a new project is not mandatory: foreigners can also purchase an existing business that generates income.

Before passing the interview, you will need to open bank accounts in a bank operating in the state and prepare other constituent documents. Compliance with all requirements and compliance with the conditions imposed on foreign entrepreneurs reduces the risk of refusal and makes doing business the most accessible way to obtain a card.

Job

Foreigners can obtain a residence permit in Slovakia if they work on its territory. Official employment is mandatory, which must be confirmed by the existence of an employment contract or agreement. An employer has the right to hire a foreigner if, within a month from the date the vacancy opens, citizens of the country are not interested in it.

Compared to other European countries, the labor market of the Slovak Republic cannot offer a large number of vacancies. The most in demand include specialists in the field of IT technology, medicine and some others. The paper industry, the automobile industry and the tourism industry are considered to be developing areas.

Studies

Studying in Slovak educational institutions is another way to obtain a residence permit in Slovakia. The authorities treat candidates applying for a card on this basis with loyalty and in most cases (provided there are no violations) make a positive decision. Foreigners enrolled in educational institutions located in the country and having accreditation (schools, universities) and Slovak language courses can submit documents.

Family reunification

Providing a residence permit based on the reunification of family members can also be considered among the popular options. This basis presupposes that one of the family members has a card. On the basis of family reunification, the spouse of the card holder, children under the age of majority, and parents (their age must exceed 60 years) have the right to apply for a residence permit. In some cases (due to health reasons), the card can be issued to adult children (up to 25 years old).

Real estate

In a number of European countries, the acquisition of property and the purchase of real estate are considered grounds for issuing a residence permit. Slovakia is not included in the list of these countries: ownership of real estate objects by right of ownership does not automatically entail the provision of status. But the presence of real estate can increase the chances of a positive decision on the application.

Residence permit based on real estate in Slovakia

For pensioners

The mild climate, high-quality medical care and well-developed infrastructure make the Republic a popular option for relocating retirees. To apply for a Slovak pensioner card, you will need to supplement the main list of documents with a pension certificate and information about your income. Pensioners must have savings, the presence of which is confirmed by an account statement.

Procedure for obtaining a residence permit in Slovakia

  1. Providing a package of documents to the consular department of the Slovak Embassy (or the local immigration police department) in accordance with the current grounds for obtaining a residence permit;
  2. Reviewing the documents provided and making a decision on issuing residence permit status;
  3. Registration of an ID card (on average takes 1-2 months).

Of course, immigration to Slovakia is one of the best options for those who plan to achieve legalization in the EU in a relatively short time. But along with loyal immigration laws, here, as in any European country, there are a number of requirements, failure to comply with which may result in denial of residence permit status. If you want to protect yourself and your future from risks, then it is better to entrust the procedure for obtaining a residence permit in Slovakia to professionals.
