He obtained citizenship based on his own desire.
Received an official document of citizenship after the regeneration.

The simplicity of this method is based on the fact that the law of the republic strongly encourages the return of the indigenous inhabitants of the republic to their homeland. Anyone wishing to obtain citizenship must follow simple steps:

Collect documents confirming the fact of birth in Abkhazia;
Write a competent statement addressed to the president;
Go through official naturalization.

You will have to wait about a year for an answer. During this time, a thorough check of papers and certificates will be carried out, and all important information will be analyzed.

If everything is in order, if the citizen is clean before the law, government officials will make a positive decision.

The long time allocated for verification and registration allows specialists to very carefully check the accuracy of the documents provided. If a counterfeit is discovered, the applicant will face problems, including criminal investigation and punishment.

Immigration for Russians

Citizens of the Russian Federation receive citizenship in Abkhazia exclusively on a general basis. Quite friendly relations have been established between Russia and this republic. Residents of these countries can live in countries with dual citizenship.

The main condition is to live in the republic for 10 years and make payments under the issued insurance policy!

If these conditions are met, anyone can submit a request for citizenship.

Documents for obtaining a passport

As noted above, obtaining citizenship is a rather painstaking and rather long-term process. You will need to collect a decent package of documents.

The law establishes a list of standard documents, but it can be supplemented with additional papers and certificates. Their list depends on the situation. The main documents that will need to be collected and attached to the application include:

Passport.
A paper that confirms the receipt of income.

An official document confirming tax payments.

If everything is fine with the documents, obtaining the requested citizenship will not take much time. If there are certain difficulties and problems, receiving paper may take much longer.

Standard registration process

Any foreigner who has reached the age of 18 has the right to become a citizen of a unique republic!

Another important requirement is legal capacity and provision of the required documents. The standard registration operation consists of performing the following steps:

The application is written according to the established template.
Knowledge of the Abkhaz language and the fundamentals of the legislation of the republic are tested.
A formal oath of allegiance is taken.

You should not take any action if the prescribed taxes have not been paid for the required 10 years.

Also, for citizens of other countries there is a mandatory renunciation of citizenship in the country of early residence. This factor must be confirmed by an official document. There is no need for it:

Why is this necessary?

The draft agreement on dual citizenship has been in the works for a long time. Legal basis – Treaty of Friendship, Alliance and Mutual Assistance between the Republic of Abkhazia and the Russian Federation of 2008.

“Article eight of this agreement states that the contracting parties will resolve the issue of dual citizenship by signing a corresponding separate agreement. Since 2009, work has been carried out with varying degrees of intensity by the Ministry of Foreign Affairs of Abkhazia and the Ministry of Foreign Affairs of Russia. Consultations were held for the first time on this agreement,” Shamba said.

The deputy head of the presidential administration noted that the agreement is intended to regulate the status of those individuals who currently have dual citizenship.

“I’ll tell you a little background. The decision that citizens of Abkhazia, without leaving Abkhaz citizenship, have the right to unilaterally accept Russian citizenship, was made by the Abkhaz side in 2002. Changes were made to the law “On Citizenship of Abkhazia,” he recalled.

When the “Law on Citizenship of Abkhazia” was adopted in 2005, the issue of dual citizenship with Russia was also reflected.

“At that time, Abkhazia could not conclude any interstate agreements with Russia, which is why we unilaterally proclaimed the principle of dual citizenship in legislation,” explained Dmitry Shamba.

According to Russian legislation, it is impossible to accept Russian citizenship without renouncing one’s national citizenship, unless this is provided for by an international agreement.

“There is no such agreement today. That is why, since 2008, from the moment Russia recognized Abkhazia, the process of acquiring Russian citizenship by citizens of Abkhazia was suspended until an appropriate agreement was reached,” he said.

The document does not provide for obtaining Abkhaz citizenship by Russians.

What are the benefits?

Dmitry Shamba said that the agreement with Russian colleagues provides that a citizen of Abkhazia, without leaving Abkhaz citizenship, can acquire Russian citizenship.

“In order to resume the process of simplified acquisition of Russian citizenship, it is necessary to sign an additional agreement, because this agreement on resolving issues of dual citizenship removes only one restriction - the obligation to renounce Abkhaz citizenship,” he said.

If there is no separate agreement, then citizens of Abkhazia, on the basis of a document on dual citizenship, will have to apply for citizenship issues only if they move to permanent residence in Russia.

“We have reached an agreement with our Russian colleagues that after completing consultations on this draft agreement, we will immediately begin working on a simplified procedure for obtaining Russian citizenship,” Shamba said.

According to him, the legislation of the republic does not establish restrictions on combining positions in Abkhazia for persons with dual citizenship.

Dialogues on citizenship

“As for the legislation of Russia, the Law on Civil Service provides for the provision that a citizen of the Russian Federation can be in the civil service despite the fact that he does not have citizenship of a foreign state, except in cases provided for by an international treaty,” noted Dmitry Shamba.

Many citizens of the Republic of Abkhazia are in public service in Russia.

“We proposed amendments that would remove these restrictions for citizens of Abkhazia. Since 2008, after the recognition of Abkhazia, a smooth process began when our citizens in Russia holding government positions renounce their citizenship of Abkhazia,” he added.

Dmitry Shamba emphasized that this process has intensified since 2014.

“As you know, in 2014, Russia made changes to its legislation and established administrative and criminal liability for persons who have dual citizenship and hold government positions,” he noted.

Since 2014, according to Shamba, more than three hundred civil servants working in Russia have renounced their Abkhazian citizenship.

The problem also exists for students studying in the Russian Federation.

“They are invited to government jobs, but they are forced to refuse work, or citizenship of Abkhazia,” the deputy head of the presidential administration gave an example.

Dmitry Shamba said that it is planned to complete consultations within six months and sign an agreement.

Minors and students

After signing an agreement on the settlement of dual citizenship, according to Dmitry Shamba, if one of the parents holds the citizenship of both parties at the time of the child’s birth, then the child receives citizenship of both Abkhazia and Russia.

“If both parents change citizenship, the child’s citizenship automatically changes as well. At the same time, there is a rule according to which citizenship does not change if there is no guarantee that the child will receive citizenship of another state so that minors do not become stateless,” he said.

Abkhaz students, noted the deputy head of the presidential administration of Abkhazia, face difficulties when studying in the Russian Federation when entering with Abkhaz passports.

“We have an intergovernmental agreement on mutual visa-free travel dated 2009, which provides that citizens of the parties can enter, arrive and leave states without obtaining visas for a period of no more than 90 days. We discussed this issue with our colleagues as part of consultations, although this topic is not the subject of resolving issues of dual citizenship,” Shamba added.

The Abkhaz side will propose amending the agreement on mutual visa-free travel in order to increase the established period of stay of 90 days to 365 days so that students do not interrupt the educational process and do not return to the republic in order to receive a migration card. The proposal of the Abkhaz side will concern not only students, but also all persons crossing the border with Abkhaz passports and working in Russia.

Registration according to a simplified scheme

The authorities of the republic provide the opportunity to obtain citizenship using a simplified scheme. This rule applies to the following categories of persons:

Investors who have invested large sums in the development of the country.
Highly qualified specialists.
Children of the indigenous inhabitants of the republic, born and living in another country.
Children under the guardianship of Abkhazians.
Citizens of other states who have distinguished themselves and have special services to the republic.
People who, for various reasons, previously changed their citizenship of Abkhazia and are seeking to return it.

Abkhazia does not provide permission to have dual citizenship. Russia is the only exception!

Registration and obtaining citizenship of Abkhazia

Some applicants are eligible for a simplified procedure. This is relevant for those foreigners who are going to invest a large amount in the country’s economy or are top-level specialists.

The process of integration into the complex and unique Abkhaz society is a long and quite painful process. Registration is completed by the preparation and submission of a complete package of all current certificates, the list of which, depending on the situation, may be supplemented with any other documents.

Problems with registration

Those interested should not count on a positive decision based solely on knowledge of a foreign language. In addition, financial well-being and official registration at the place of residence in the republic will not be a direct basis.

If there are certain problems, the applicant may have problems during registration. Among such unfavorable situations it is worth noting:

Early imprisonment. The exception is the cancellation of the contract;
Finding a person under investigation;
Work in the military service of another state, in law enforcement agencies or in the structure of ensuring general security.

With such prohibitions, migration control reduces the likelihood of obtaining citizenship by a person whose activities could violate the security of the republic.

Citizenship through marriage

A foreigner can marry a citizen of the republic if the following conditions are met:

At the time of registration, residence in the territory of the republic for at least a year.
It is mandatory to have a temporary residence permit.

The person immediately receives a new passport. It is up to you to decide whether to obtain citizenship or not. All that a person instantly receives after marriage is a permanent residence permit.

Marriage registration does not automatically grant citizenship. Divorce is also not a reason for annulment.

Marriage with a citizen of the republic is one of the few ways of registration according to a simplified scheme. This is a special exceptional situation in which 10 years of residence in the republic is not a mandatory requirement.

An exclusively individual approach is applied to each situation related to marital relations. But on average, a person is required to live in a marriage for at least 3 years.

Grounds for acquiring Abkhazian citizenship for Russians

The country's authorities have created a number of grounds that are a priority for obtaining citizenship of the country. What they include:

Born on the territory of Abkhazia during the period of its independence.
Residence of relatives of a citizen on the territory of the state.
The presence of Abkhazian roots in a Russian.
Acquiring refugee status and notifying the migration department.
Availability of permanent residence and duration of residence in the state for more than 10 years.

The authorities of Abkhazia do not consider other reasons for registering citizenship.
