Does the “90/180 rule” apply to citizens of the DPR/LPR?

Integration of Donbass: The State Duma will abolish patents for citizens of the DPR and LPR

By the end of March, bills designed to facilitate the stay in Russia of citizens of the Donetsk and Lugansk People's Republics will be submitted to the State Duma for consideration.

There are currently two initiatives in development: the first proposes to abolish the limitation on the length of stay of migrants, the second proposes the need to obtain a patent for employment. Amendments to Federal Law No. 115 “On the legal status of foreign citizens in the Russian Federation” apply to migrants who have documents issued in the DPR and LPR.

“I consider it right to insist on a complete migration amnesty for residents of the Donetsk and Lugansk People’s Republics.

For this, there is both political will and the corresponding instrument - the February (dated February 18, 2021 - editor's note) presidential decree on the recognition of documents of the LPR and DPR,” one of the authors of the bills emphasized in an interview with the Parliamentary Gazette, Member of the State Duma Committee on Financial Market Andrey Kozenko.

Until now, attempts to ease the migration burden for migrants from Donbass have looked like half measures, the deputy believes.

“It all comes down to solving the problems of staying people who are called “migrants”. The word “compatriots” is not mentioned anywhere.

At the same time, we are talking about people who are at the forefront of protecting the Russian world. We line up these people,” the legislator explained.

The migration situation in Russia forces the authorities to take a rather tough position towards migrants. Hence the “90/180” rules, patents, and so on. These rules apply to visitors from visa-free countries - Tajikistan, Uzbekistan, Azerbaijan and Moldova.

For now, they also apply to residents of Donbass, including those who have DPR or LPR passports, since in Russia they are officially considered citizens of Ukraine, which never joined the EAEU.

Difficulties of resettlement

But taking into account the conditions prevailing in the Donbass republics, such an attitude towards migrants on the part of Russia is simply inhumane, a member of the Federation Council Committee on International Affairs, Sergei Tsekov, who is also involved in the development of bills on a migration amnesty, is convinced.

“Firstly, there is fighting there, and people are leaving the front-line areas. Secondly, both republics are under blockade - economic, transport, periodically there is a water blockade, industry has been stopped there,” the senator explained.

According to him, residents of Donbass go to Russia for two reasons: some are fleeing hostilities, others are looking for work to provide for their families remaining in the region.

Now, without a patent or other permits, people from Donbass can stay in Russia for a total of 90 days out of 180. That is, if a person has continuously stayed in our country for 90 days, then he must spend the next three months outside the Russian state.

The scale of the problem will be illustrated by simple statistics from the website of the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation: during 2021, about 1.8 million people arrived in Russia from Ukraine and Donbass. More precisely, so many people registered for migration - this is the only public form of registration of arriving citizens.

Of these, the vast majority - about 1.6 million people - oh, that is, they are subject to the “90/180” rule.

All these people need to obtain a patent in order to work in Russia. And this requires costs.

“A labor patent itself costs a certain amount of money (in Moscow, for example, 4,500 rubles per month - editor's note). And in order to get it, you need to undergo medical examinations, pass exams, and so on. According to our information, in total it costs 10–15 thousand rubles,” said Sergei Tsekov.

According to the senator, the measures proposed in the bill are temporary, just like the fundamental decree of President Vladimir Putin on the recognition of “republican” documents. “When the war in Donbass ends, then we will cancel all this. Maybe. Or maybe we won’t cancel it—life will tell,” the legislator summed up.

Receipt procedure

A person can become a citizen of the Russian Federation:

  • upon birth;
  • during life;
  • restored to its affiliation with Russia.

Federal Law No. 62-FZ establishes the procedure in which Russian citizenship by birthright is acquired by a foreign citizen or stateless person.

General procedure

The general procedure is relevant for any foreign citizen or stateless person who:

  • has a residence permit and has been living under it in the Russian Federation for at least 5 years;
  • has a means of subsistence (earns money, has bank deposits or savings);
  • speaks Russian;
  • ready to comply with the Constitution and laws of Russia;
  • applied for Russian citizenship.

All these conditions must be met simultaneously.

The period of residence in Russia with a residence permit is reduced to 1 year for:

  • refugees;
  • people who have been granted political asylum;
  • outstanding figures of culture, art or science.

Simplified procedure

The simplified procedure involves the provision of citizenship to persons who do not have five years of living experience in the Russian Federation with a residence permit. The same procedure establishes the acquisition of Russian citizenship for citizens of the DPR in 2021, although rules about the DPR and LPR were introduced by separate presidential decrees.

As a general rule, the following may apply for a simplified procedure:

  • people living abroad of Russia, who have at least one parent who is Russian and lives here;
  • former citizens of the USSR who live in one of the member countries of the USSR and do not have any citizenship;
  • spouse of a citizen of the Russian Federation, if the marriage was concluded more than 3 years ago;
  • disabled parents of adult Russian citizens;
  • Individual entrepreneurs (individual entrepreneurs) who have been working in the Russian Federation in this status for at least 36 months and have paid at least 1 million rubles in taxes to the budget;
  • investors of large enterprises (share in the authorized capital - at least 10%, term - from 3 years, the size of the authorized capital of the enterprise - from 100 million rubles, the amount of taxes paid by a legal entity - from 6 million rubles);
  • highly qualified specialists working in the country for at least 3 years;
  • graduates of Russian universities after July 1, 2002, who have been working for more than 3 years, and the employer pays insurance contributions to the Pension Fund for them;
  • a foreign parent of an incapacitated child - a citizen of the Russian Federation, if the second parent was also a citizen and died or was deprived of parental rights.

Compatriots Resettlement Program

The program for the resettlement of compatriots started in 2006. It is focused on the return of native Russians to their homeland. Compatriots are recognized as persons belonging to the nationalities that historically inhabited our country, immigrants from the Russian Federation, the USSR, who had Russian citizenship but lost it, descendants of immigrants from the Russian state, the Russian Federation or the USSR.

A specially created commission recognizes a person permanently residing in the Russian Federation as a native speaker of the Russian language, and this person receives a Russian passport while simultaneously meeting only three conditions:

  • willingness to comply with the Constitution of the Russian Federation and its laws;
  • availability of a source of income;
  • renunciation of citizenship of another state, if any.

Patent tax system: what is it?

After the Law “On the Tax System” came into force, another tax system appeared in the Donetsk People’s Republic - the patent one. Many entrepreneurs wondered whether it would suit them and rushed to get clarification about the new law. Moreover, the innovation prompted residents of the republic to think about opening their own business, because for a developing business such a load seems quite feasible.

The law makes several main points:

  • This system sets turnover limits - up to 1 million Russian rubles per year.
  • Also, the patent prohibits engaging in foreign economic activity.
