Representatives of the public foundation spoke about what types of visas exist in the Kyrgyz Republic, which countries are subject to visa-free regimes and simplified procedures for obtaining visas, in what order a foreign citizen can obtain one and how to register correctly so as not to become an offender or a victim of a violation by authorized persons.
First of all, before visiting the country, along with the history and sights, you need to familiarize yourself with the peculiarities of domestic legislation and take care of the correct execution of permits, and after arrival, the registration of documents with the relevant authorities.
Different countries have different rules for obtaining a visa and registering after arrival, depending on what agreements are in place between the countries. If a country has a visa-free regime, you can visit the country without obtaining a visa using one of the valid documents, and you do not need to register anywhere upon arrival if the period of stay does not exceed 2-3 months. This also applies to those countries whose citizens receive a visa under a simplified procedure (Article 6 of the Law “On External Migration”).
Foreign citizens or stateless persons staying in the Kyrgyz Republic must have a valid document. A foreign citizen or stateless person must immediately report the loss of an identification document to the nearest branch of the authorized state body in the field of population registration or a diplomatic mission or consular office of the state of origin and receive written confirmation of this fact.

If a foreigner overstays his visa, what should he do? Where to go, where to pay the fine, where to draw up a protocol, what to do with this protocol?
Violation by foreign citizens or stateless persons of the procedure for staying in the Kyrgyz Republic, that is, staying on the territory of the republic for a purpose that does not correspond to that stated at entry, living without documents for the right of residence or living with invalid documents, failure to comply with the established procedure for registration or movement, choice of place of residence , evasion of departure after a certain period of stay, as well as failure to comply with the rules of transit travel through the territory of the Kyrgyz Republic will entail the imposition of an administrative fine of 1 to 2 thousand soms. If a foreign citizen violates the law again within one year, he will be expelled from the country. Expulsion, in turn, is grounds for restricting access to the country.
In case of violation, the issue of imposing an administrative penalty is assigned to the internal affairs bodies. The police officer will have to draw up a report on the administrative violation, give a copy to the person brought to administrative responsibility, after which the foreigner must make the appropriate payment to the bank. The process should take place in this order, and not vice versa.
If a person brought to administrative responsibility does not agree with the charges brought, he has the right to appeal the protocol on an administrative offense to the court. In this case, it is recommended to make a note in the protocol of disagreement in advance and state your version of the violation.
In case of repeated violation of the same article, the police officer does not have the right to impose a fine; he only draws up a report on the administrative offense and sends the case materials to the court. It should be noted that he does not have the right to make detention, but will limit himself only to delivery, which is carried out as soon as possible.
What if the visa expired on a weekend and he was unable to renew it on time? If a foreigner who paid the fine believes that he overstayed his visa not through his own fault, but due to insurmountable circumstances or the fault of OVIR employees, can he appeal the protocol (or what can he appeal against?)? If yes, what should he do for this?
It should be noted that it is best to do the documents in advance on the reception days, at least 10 days before the expiration of the visa, since this period is necessary to consider the issue of its extension or refusal. If there was an unplanned day off on the day when the foreign citizen came to submit an application, this is considered a circumstance excluding administrative liability, i.e. due to things beyond the will of the citizen, he became a violator. But if, despite this, the police officers have already drawn up a report on an administrative offense, then it is best to appeal it in the court of the same district, whose officers drew up the report.
In court, it is necessary to state all the circumstances of the case and attach a copy of the protocol on the administrative offense; when drawing up a complaint to the court, it is better to use the help of a lawyer.

What if a foreigner overstays his visa twice? Does the State Registration Service have the right to demand payment of the fine a second time?
The State Registration Service does not have the right to demand payment of a fine; in accordance with the Code of Administrative Offenses of the Kyrgyz Republic, this offense (provided for in Article 390) is within the jurisdiction of the internal affairs bodies and the court.
In case of repeated violation by a foreign citizen of the stay order within a year, only administrative expulsion from the Kyrgyz Republic is applied, i.e. There can be no question of reimposing the fine.
But in general, in accordance with the Constitution, foreign citizens and stateless persons enjoy rights and perform duties on an equal basis with citizens of the Kyrgyz Republic, except in cases established by law or an international treaty to which the Kyrgyz Republic is a party.
