When moving to the territory of the Russian Federation, pensioners can count on a pension only when they receive Russian citizenship or a residence permit. However, the procedure for obtaining citizenship is simplified for citizens of the former USSR.

A bill has been registered in the Verkhovna Rada that could simplify the system for receiving payments. It is proposed that residents of temporarily uncontrolled territories be paid pensions without issuing a migrant certificate. This was reported by the adviser on issues of internally displaced persons of the Ministry of Social Policy of Ukraine, lawyer Irina Loyuk.
What documents are required to be provided to migrants to receive a pension?
First of all, to receive pension benefits, you need to collect the required package of documents. Their list was approved by a special order issued by the Ministry of Labor of the Russian Federation.
Relocating persons must provide the following documents:
- Russian passport or residence permit, indicating the place of registration;
- application of a certain sample;
- insurance certificate of the Pension Fund of the Russian Federation.

After the issuance of pensions for residents of Donbass was suspended last year, many are interested in only one question: will pensions be paid to displaced people from the ATO zone in 2020? According to Prime Minister of Ukraine Vladimir Groysman, all payments will be paid on time. But first, as last year, you will need to check the place of registration of the pensioner as a temporarily displaced person.
In addition to submitting an application to the Pension Fund, the migrant must register an Oschadbank card. If a Ukrainian previously received pensions, he restores the payments, the card is valid, he just needs to write an application to transfer the pension to this card.
Terms of consideration
Based on the submitted application, the issue of providing pension payments is resolved within a ten-day period. If the request is granted, the due payments will be resumed (if the citizen was previously provided with them in his previous country of residence) or they will be assigned. You can submit your application in person, by mail or through a proxy.
The accrual of funds begins from the next month from the day the application was submitted. Cash security is calculated from the moment the application is filled out or the state border is crossed. It is worth considering that temporary migrants will not be paid pensions.
Important! If a citizen continues to work upon reaching retirement age, his social security benefits for old age are cancelled. The insurance payment will continue to be made, however, indexation will not be carried out annually in order to increase its amount.
Payments of pensions to immigrants
To understand this issue, it is necessary to disclose in detail some provisions of the international Agreement on the recognition of work experience in Russia. It is its norms that regulate this process; they are guided by government bodies when calculating pensions for immigrants, namely:
- For immigrants from the above countries, their work experience and insurance period are maintained. This means that all work activities of these persons will be taken into account by the Russian authorities. If the migrant’s work book contains notes about places of work, they will be accepted as the basis for calculating old-age maintenance;
- An important circumstance is the presence of insurance experience of at least 7 years. The person is required to present a certificate to this effect from his national Pension Fund. The wage insurance system exists everywhere and is recognized in all countries. Therefore, obtaining it will not be a problem. But it is recommended to take care of this in advance;
- Another condition for calculating maintenance is that a person reaches the age that is accepted in Russia as retirement age. It is currently set at 60 for men and 55 for women;
- If a person worked in dangerous conditions and has the right to receive a preferential pension or maintenance based on length of service, such circumstances will be accepted in Russia.
Calculation/recalculation procedure
Calculation of pension benefits due to migrants upon reaching a certain age is carried out according to the following scheme:
- NB - accumulated points for the cumulative periods of fulfillment of a citizen’s labor obligations.
- SB - the value of the point at the time when the pension payment was issued. Starting from 04/01/17 it is equal to 78.58 rubles.
- FV - the amount determined by law. It is equal to 4805.11 rubles.
For example, a citizen scored 30 points. In this case, the pension will be calculated as follows:
30 × 78.58 + 4805.11 = 7162.51 (rub.).
Pensions will be paid to migrants who have a disability group according to the formula presented above, if they have at least one day of work experience and insurance premiums have been deducted for them during this period of time. If this requirement is not met or the applicant refuses to pay the insurance amount, the displaced person is assigned a social disability benefit.
Do I need an IDP certificate to receive a pension?
Deprivation of pension payments for residents of the Donetsk and Lugansk regions is the second most important problem after military operations. Even in the case of permanent residence in a territory controlled by the Ukrainian government, a pensioner cannot be sure that tomorrow he will continue to receive his pension.
Stopping payments, for various reasons, is a fairly common problem for a displaced pensioner. In Western countries there is no concept of an internally displaced person; a citizen of his country remains a citizen and no certificate is required, but Ukrainian realities are different. Why should a citizen of Ukraine receive a certificate stating that he has moved to live from one region to another in order to continue to be paid a state-guaranteed pension?
The procedure for pension payments to immigrants
Having crossed the Russian border, the migrant undertakes to submit an application for the need to obtain refugee status, as well as to carry out temporary registration.
After this, in the manner established by the provisions of the legislation of the Russian Federation, this category of persons can submit a package of documents required in order to obtain a residence permit in accordance with the provisions of Federal Law Article 8 No. 115. This will allow them to subsequently count on obtaining permanent registration.
As soon as the required documents are completed, the displaced person can apply for financial social security from the Pension Fund of the Russian Federation at his place of residence or according to his temporary/permanent registration. To do this, you will need to submit an application along with documentation, the list of which is specified in Article 21 No. 400.
After the provided documents have been examined to determine whether they are reliable and the amount of pension provision has been determined, payments will begin to be transferred to the citizen’s bank card or delivered by the postal service in accordance with the procedure established by law.

Each migrant at the place of registration receives a card for payments from the state Oschadbank. It is also his identification document, which contains the following data:

Anyone who needs one can get such cards. Moreover, it is mandatory to indicate your residential address when receiving the card. This must be a real address, and not, for example, data from the Social Security Administration. If there is none, then you will not be able to apply for a card for receiving a pension and personal identification.
Every 6 months you need to undergo personal identification. To do this, you should visit a state bank to submit your documents for examination. If identity cannot be verified, the pensioner will lose the payment.
Pitfalls and practical recommendations
The main questions arise when a migrant plans to change his or her already registered place of residence by moving to the territory of another region. In such a situation, in order to be able to receive the required pension benefits in a new place, a personal visit to the territorial department of the Pension Fund of Russia is necessary. Employees will help you fill out an application that will request the citizen’s payment file from the old place of registration.
Important! The civil service generates an application within one weekday. Documents requested by employees are sent within three days after requesting them. As soon as the papers are received, the size and correctness of the pension provision will be reviewed.

What to do if the pension payment to a displaced person is stopped?
Internally displaced persons (migrants) have the right to receive a well-deserved pension in the territory controlled by the Ukrainian authorities at the place where the certificate of registration as an internally displaced person was issued. At the same time, the state exercises increased control over the payment of pensions to immigrants.
Types of checks of migrants
Various types of checks of migrants have been established, as a result of which pension payments may be terminated:
- Verification of the actual place of residence at the address indicated by the migrant upon receipt of the certificate.
- Physical identification at PJSC Oschadbank.
- Verification by the Ministry of Finance of Ukraine (checking the accuracy of the data provided by the migrant for calculating social benefits).
- Check for stay in uncontrolled territory for more than 60 days.
- Check of the Security Service of Ukraine (so-called “SBU lists”).
Mechanism for monitoring payments to migrants
Control over the implementation of social payments to internally displaced persons is carried out by structural units for social protection of the population of district, district in Kiev state administrations, executive bodies of city, district councils in cities (popularly called Social Security) by visiting the actual place of residence of the displaced person and drawing up a financial inspection report - living conditions of the family.
Frequency of Social Security inspections
Social Security carries out regular and extraordinary inspections of displaced persons.
The next inspection is carried out once every 6 months.
Moreover, if by the time of the next inspection the migrant has passed the physical identification procedure at Oschadbank, then the next inspection will not be carried out in the corresponding period.
Additional verification may be carried out in the following cases:
- receipt of information about a possible change by an internally displaced person of their actual place of residence (in accordance with the law, displaced persons are required to notify Social Security of the change of residence address within ten days);
- receipt of information about the return of an internally displaced person to the temporarily uncontrolled territory of Ukraine (if the person is in the uncontrolled territory for more than 60 days, the Border Guard Service of Ukraine transmits data about this to Social Security) or his departure abroad;
- receipt of information from PJSC Oschadbank of Ukraine about the failure of an internally displaced person to undergo physical identification within the prescribed period;
- receiving recommendations from the Ministry of Finance based on the results of verification of social payments, indicating specific reasons for terminating the corresponding payments.
Based on the results of the inspection, if the displaced person was absent from his actual place of residence and did not appear at the Social Security Service within six working days after the inspection, the Social Security Service, if there are grounds, makes a decision to cancel the certificate of registration of an internally displaced person and makes a consideration by the Commission on the assignment (restoration) of social payments to internally displaced persons; a proposal to terminate social payments to such a person.
Grounds for termination of pension payment:
- establishing the fact of the absence of an internally displaced person at their actual place of residence;
- recommendations of the Ministry of Finance on facts identified during the verification of social payments;
- the fact of cancellation of the certificate of an internally displaced person.
The commission, within five calendar days, considers the proposal to terminate social payments and makes an appropriate decision.
The Pension Fund of Ukraine, based on the decision of the Commission, stops paying pensions from the month following the one in which the corresponding decision was made, and in case of failure to undergo physical identification at JSC Oschadbank on time - from the day the payment is blocked by the bank.
The procedure for restoring pension payments
The displaced person has the right to restoration of pension payments. To do this, you need to go through the same procedure again as for the initial assignment of pension payments:
The first step is to obtain the status of an internally displaced person (in case the certificate is canceled based on the verification results)
To obtain a certificate of registration of an internally displaced person, you must personally contact Social Security with the appropriate application.
When submitting an application for registration of an internally displaced person, the applicant presents a passport of a citizen of Ukraine with a mark of registration of place of residence (propiska) in an uncontrolled territory. On the day of submitting the application, a certificate is issued free of charge, which is printed on an A4 sheet, signed by an official of the authorized body and sealed with the seal of such body.
If a pensioner does not have a residence permit in an uncontrolled territory, he must provide evidence confirming the fact of residence in this territory on the day of the occurrence of the circumstances that led to internal displacement. Such evidence may be: a military ID with information about military service, a work book with records of work activity, a document confirming ownership of movable or immovable property, medical documents, photographs, videos, etc. In this case, Social Security is obliged to consider the application within 15 working days and make a decision on issuing a certificate or refusing to issue it.
The certificate of registration of an internally displaced person is valid indefinitely.
The second step is to contact the Pension Fund of Ukraine
It is necessary to personally contact the Office of the Pension Fund of Ukraine in the territory (in a district, city, district within a city) where the pensioner is registered as an internally displaced person.
In this case, you must provide the following documents:
- application for requesting a pension file (in case of registration of a migrant at a new address);
- a copy and original of the certificate of registration of an internally displaced person;
- copies and originals of documents that identify the pensioner: passport, pension certificate;
- a copy and original of the certificate of assignment of an identification number (if available);
- application for transfer of pension to an account at JSC Oschadbank.

The third step is to pass a Social Security check
To restore the payment of a pension, Social Security, based on an application from the Pension Fund management, within 15 working days checks the accuracy of the information specified in the application about the actual place of residence/stay of the internally displaced person. Based on the results of the inspection, an inspection report on the family’s material and living conditions is drawn up, which is signed by the internally displaced person and representatives of Social Security.
Then, Social Security, within three working days from the date of drawing up the report on the inspection of the family’s material and living conditions and receiving the applicant’s electronic file, submits a proposal on the appointment of pension payment for consideration by the Commission on the assignment (restoration) of social payments to internally displaced persons. The corresponding commissions were formed by district, district in Kiev state administrations, executive bodies of city, district councils in cities.
The commission considers the application for pension restoration within five working days and no later than the next working day after the decision on restoration / refusal to restore is made, sends copies of its decision to Social Security and the Pension Fund Administration.
Pension renewal deadline
If the payment of a pension was terminated due to the fact that an internally displaced person was absent from his actual place of residence, payments are resumed two months from the month of the decision to terminate such payments. The Commission may decide to resume social payments to internally displaced persons from the month of termination of such payments in the case where such a person is in difficult life circumstances and, for good reasons, did not appear on time at Social Security to undergo an inspection.
If the payment of the pension was terminated on the basis of receiving recommendations from the Ministry of Finance regarding the facts identified during verification, then, by decision of the Commission, the payment of the pension can be restored from the month following the one in which the facts identified during the verification were eliminated.
If the payment of the pension was terminated on the basis of the cancellation of the certificate of registration of an internally displaced person, re-assignment of the payment of the pension is possible only six months after such termination.
Many citizens of the former Soviet republics move to Russian territory to live and work. A striking example of this is the events in Ukraine: Donetsk and Lugansk regions, where hostilities have been ongoing since 2014. The number of forced migrants includes a large number of pensioners who are concerned about the procedure for receiving required payments in Russia. And one more thing: according to written applications from persons with group I disabilities and persons who are not capable of self-care and need constant outside assistance, payments can be made by Oschadbank free of charge with home delivery (at the actual place of residence) with simultaneous identification of the pensioner’s identity.
Over the next five working days, the commission for the appointment (restoration of social benefits of IDPs) makes an appropriate decision, on the basis of which the Pension Fund assigns (resumes) payment of a pension or refuses to the applicant.
