Is it possible to obtain a foreign passport by power of attorney - in 2021

Can I pick it up or not?

Despite the fact that there are a large number of companies involved in issuing foreign passports, the procedure is prohibited by law. It is allowed to obtain a foreign identity card only in several ways, prescribed in the law “On the procedure for leaving the Russian Federation and entering the Russian Federation.”

In accordance with Article 8 of this regulatory act, you can pick up a passport for trips abroad:

  • during a personal visit;
  • through a legal representative, such as the mother, father, guardian or trustee for a minor child;
  • remotely when drawing up a document not at the place of registration, but at actual residence.

A stranger will not be able to receive a ready-made passport for several reasons:

A foreign passport allows you to confirm a person’s identityTo exclude fraudulent activities, it is transferred only to the applicant himself.
The new format document requires the submission of biometric materialRussia and Europe have introduced the rule of submitting fingerprints, which are unique to each person. The representative will not be able to go through this procedure instead of the applicant.
A new passport photo is taken directly at the Ministry of Internal AffairsThe old-style document provides for the transfer of a photo along with the rest of the package of documents. No one can take part in the shooting for another person.

An old-style passport does not require a photo or biometrics. Previously, it was assumed that it was possible to obtain it by proxy, but in 2021 the law prohibits this.

Can another person pick up a passport with a power of attorney?

For any trips outside the country, Russian citizens need a foreign passport.

It happens that the document is already ready and waiting for the recipient at the migration center, but due to circumstances the applicant cannot receive it in person.

Rarely, but this happens due to old or young age, illness, long business trip, etc. Many try to find out in advance whether it is possible to obtain a foreign passport by proxy in the event of an emergency.

When might a power of attorney be needed?

In any case, a power of attorney from a notary is not needed. At the moment, it is not possible to obtain a foreign passport by power of attorney. Any adult citizen-applicant must appear for the document at the migration authority. It is for this reason that the production and receipt of a foreign passport through any intermediaries is considered illegal.

To obtain a foreign passport, a power of attorney from a notary is not required

You can obtain a visa to other countries using a power of attorney, so people often mistakenly think that they can obtain a foreign passport without the personal presence of the applicant if they issue a power of attorney in advance. In fact, no third party has the right to submit an application for you or receive a passport.

What to do if the deadline for issuing the document has come, but you cannot come in person, can another person pick up the passport?

Shelf life of a completed passport

If the document is already ready and waiting for you at the department, you can pick it up later than the appointed time. The passport must be kept in the migration service until its expiration date.

Although the answer to the question: “Can another person take away a foreign passport?” – negative, established standards for its storage solve many problems.

If you do not have the opportunity to receive a passport immediately after production, but do not need the document urgently, there is no need to worry. You can come and pick it up when you can.

Are there exceptions when another person can take away a passport from a legal point of view?

Despite the strict rules for obtaining a document, there are exceptions when personal presence will not be required.

You can pick up the document later than the appointed time if it is not possible to pick it up on time

Receipt for a child

This is one of two exceptions to the rule, when a healthy citizen may not come in person to receive a document. But in this case, obtaining a passport by power of attorney is not required. To obtain a passport for a minor child, you must bring a birth certificate. Similar conditions apply to guardians, only documentary evidence of guardianship will be confirmed.

To apply for and receive a child’s document, you will need the following:

  1. A questionnaire addressed to him.
  2. Receipt for payment of state duty.
  3. Passport of the child's representative.
  4. 2 photographs of the established sample.
  5. Child's birth certificate and its copy.
  6. Insert for the certificate with information about citizenship.

Receiving instead of husband, wife or other relatives

If your close relative is healthy, he will have to appear in person at the migration service to receive the document.

But there are situations when a person is recognized as incompetent or with limited legal capacity (due to drug use, alcohol, gambling or mental disorders). Then, instead of him, a guardian or trustee can come to pick up the completed passport.

In a similar situation, you will need a power of attorney to obtain a passport at the visa center after submitting documents for a visa.

A power of attorney will be required to obtain a passport at the visa center

Receiving for a stranger

The question: “Is it possible to obtain a foreign passport using a notarized power of attorney?” often arises. This possibility is not provided for by law if the person has legal capacity and you are not his guardian. A power of attorney certified by a notary does not give such a right.

The applicant will have to come for the finished document, as it is necessary to confirm his identity.

Can you trust companies that offer to obtain a foreign passport for a person?

Now you can find many offers of services for registering and obtaining a foreign passport without your presence. But Russian citizenship does not provide for such an opportunity, and any offers from supposed intermediaries are a scam.

Registration of a foreign passport by power of attorney is also impossible, so you should not believe any proposals to make your life easier and resolve this issue without your presence. By agreeing, you can only waste time and money. They may show you a power of attorney to obtain a foreign passport, a sample of which will inspire confidence, but such a document is in fact invalid.

Ways to simplify obtaining a passport

Currently, you can issue and pick up a completed document with minimal time. If you do not have the opportunity to write an application for registration with the FMS, you can do this on the State Services website at any convenient time.

Do not forget to indicate the address of your actual residence if it is not possible to come to the institution at your place of registration. Once you are notified that the document is ready, you can pick it up.

If you have left the city or cannot appear immediately for health reasons, your passport will be stored at the migration service until you pick it up yourself.

Obtaining a passport to travel abroad in the Russian Federation is accompanied by strict rules. They exist to protect people from being scammed, and changes are not expected in the near future.

A legally capable applicant must receive the completed document himself and sign in the presence of a migration service employee.

Issuing a passport by proxy is illegal, even if the authorized person is your close relative.

How to arrange everything correctly

There are no legal restrictions on obtaining a visa through proxies, or obtaining a stamped passport. However, this applies to cases with short-term resolution. A long-term visa requires an interview and fingerprinting.

The powers of the trustee include:

  • handing over a set of papers to a specialist at the visa center;
  • collection of information, representing the interests of the applicant;
  • payment of state duty and other fees;
  • obtaining a foreign passport containing a completed visa.

The procedure through a trusted representative is similar to what the citizen himself would go through. The difference is the expanded list of documents. Additionally, a power of attorney and an identity card of the representative are attached.

When you can do without additional documents

There are several situations in which you can obtain a foreign passport through a representative:

The father or mother of the child can apply if the latter is a minorThe application form for issuing a passport for foreign travel is filled out by one of the official representatives. The same right is available to guardians and trustees under whose care the child is. But it is valid only until the minor turns 14 years old.
Representation of interests is possible if a person is incapacitatedThey are not only officially recognized citizens, but also persons suffering from serious illnesses. When a passport is issued in their name, the document is received by guardians according to the law.

If documents are submitted for a child or an incapacitated citizen, a power of attorney is not required. But you may need to provide:

  • a court order stating that guardianship has legal grounds;
  • certificates confirming the fact of the child’s birth and the presence of biological parents;
  • documents reflecting the fact of adoption, establishment of guardianship for stepchildren.

There are several features of obtaining a passport for children traveling abroad.

When a child is issued a passport of a citizen of the Russian Federation at the age of 14He receives the right to represent his interests independently. He will pick up the completed document himself, but in the presence of his parents.
If the child is under 14 years oldYou may not need a passport at all. This is provided if the parent has an old-style international passport. It will be enough to enter information about minor children in it.

How to get a passport through State Services

Registration of a passport for trips abroad can be carried out through the State Services portal. Incapacitated persons who have accounts in the system can transfer data from the account to third parties. It is important to remember some subtleties of the procedure.

The website notes that only the account owner can use his personal account. If it is missing, you need to create it by entering personal information, contact phone number and email address.

To work with your account, you need to confirm it. In this way, the identity of the applicant is verified. There are several confirmation methods reflected on the portal.

If the child is under 14 years old, you can create an account for him through the State Services of a simplified form. It is linked to the parent’s personal account.

To do this, you must follow the instructions:

  1. The parent must be logged into their own account.
  2. Next, you need to go to the section containing personal information. In it you need to find a line where you can enter information about a minor child. Personal data is entered into it in accordance with supporting documents. It is important to constantly check them, as mistakes made can lead to problematic issues in the future.
  3. After saving, you should return to the section containing information about the minor. Next to the name there will be a “Get binding code” button. The code that appears must be copied.
  4. Next, you log in to the minor’s account. In it you need to select a block with documentation. The details of the birth certificate are entered in the appropriate lines.
  5. Next, you need to click the “Link” button, which is located next to the information from the birth certificate. The code copied earlier in the parent’s account is entered into the line that appears.

As a result of such actions, the child’s account is linked to the parent’s account.

If a minor has a passport, registration actions are carried out independently. The child can determine whether he wants to create a simple or regular account. The first provides a limited list of available services, while the second provides a standard one.

When creating an account, you need to reflect all personal and passport data. It is important to save them in the system.

The information is verified by specialists from the Ministry of Internal Affairs and the Pension Fund of the Russian Federation. By law, this is carried out within 5 days. But most often the answer appears within 10-15 minutes. It is provided in the form of a message to the phone or a letter sent by email.

The minor will need to confirm his identity and can do this in two ways:

The password can be sent by registered mailThe code is entered on the portal. You can receive the letter at the Russian Post office at your place of registration.
Visit to the MFCYou can activate your account by contacting the center staff. You must have a civil passport. Through an activated account you can place an order for a foreign passport.

Registration of a foreign passport from your own account in the name of another adult is prohibited. The function is not presented on the State Services portal.

If an adult does not have Internet skills, then you can help him create a personal account. If he has an account, he can tell the assistant his login and password.

A capable person receives the document independently. Otherwise, a relative can do this with a power of attorney.

It is important not to share your personal login information with third parties. Even if the information is requested by MFC employees and lawyers.

Will my passport be taken away? In what cases is it possible to confiscate the ID? |

A citizen of the Russian Federation can have two foreign passports at the same time - an old one and a new one. However, few people know about this.

When owners of foreign passports that are still valid want to get biometrics done, they start looking on the Internet for information about whether the previous generation’s passport will be taken away.

In addition, many are also interested in whether another person can pick up a finished foreigner if its owner is not able to come for it in person. Below we will give detailed answers to these questions, as well as consider situations in which the document can actually be taken away.

For each case, the answer to the question of whether a foreign passport will be taken away must be sought not on the Internet, but in primary sources:

Only current regulations will give a correct and comprehensive answer. The information below is provided based on an analysis of the current legislative framework.

Will they take away your passport if you apply for a second one?

Since 2015, every citizen of the Russian Federation can have two foreign passports, with the exception of those who are subject to a temporary or permanent ban on traveling outside the country.

Such persons include:

  • military personnel;
  • having access to secret data;
  • FSB officers;
  • bankrupt.

At the same time, it is possible to make a second passport only if we are talking about biometrics. Permission for re-registration and simultaneous storage does not apply to old-style documents. That is, you cannot have two old passports with a five-year limitation period at the same time.

Thus, to the question - will your international passport be taken away when you apply for a new one - you can give an unequivocal answer: no, they won’t.

Will the foreigner be taken away when it is replaced?

For people who have an expiring visa in their foreign country, this is a rather painful issue, since its solution can result in lengthy bureaucratic red tape.

Every citizen has the right to keep an outdated document without handing it over to employees of the Migration Department of the Ministry of Internal Affairs. Information about this should be posted in each department on the information stand.

However, a visa that has not expired usually continues to be valid even in an outdated passport.

But to be completely sure, it is better to call the consulate of the state that issued the visa and get a competent answer from its employee.

In practice, they usually recommend crossing the border with two passports at once - a new one and an old one, so as not to do double work - not to put a stamp on the new document.

Change of surname: will they keep the old passport?

The identity card itself does not cease to be valid and there is no urgent need to change it urgently.

However, much also depends on what stage of the surname change is being considered:

  • Immediately after the wedding, before the person receives an internal passport with a new surname, no one takes the international passport. The old foreign policy continues to operate and still remains with the person who changed his name.
  • When it comes to submitting documents for a new foreign country, no one confiscates the old document either. You can even successfully use it to travel abroad if the visa and tickets are issued under the same last name as in the old foreign country.
  • After the issuance of a foreign document issued with a new surname, the old document is confiscated (but can be left as a “souvenir” at the request of the person). It is declared invalid and annulled.

At the same time, the law does not clearly stipulate the time frame within which it is necessary to replace a foreign passport with an old surname with a new one. In fact, a person can safely travel along it for some more period, since no one checks his internal passport abroad, and if he had visas opened under his old surname, then they continue to be valid in the same way.

But if you have to apply for a new visa, in this case you will definitely have to apply for a new foreign passport and return the old one, since to obtain a visa you need to show both your internal and foreign passport.

If a woman got married, changed her last name, but then after some time got divorced and returned her maiden name, the old foreign name continues to have legal force and can be used again. This applies to cases where a new document was not issued and the old one was not withdrawn.

I found a lost passport when I had already made a new one: what to do?

All data about a lost passport, if a new one is issued, is entered into the database, that is, if you try to cross the border with an old passport, problems will arise. After you report to the Migration Department of the Ministry of Internal Affairs that you have lost your passport, it will be invalidated.

If it is found, you need to contact the competent authority, where it will be subject to confiscation.

Can another person pick up my passport?

Neither your wife, nor your husband, nor any other relative, including parents, nor even an authorized person for whom a notarized power of attorney has been issued, will be able to pick up your completed passport from the Ministry of Internal Affairs.

According to paragraph 163 of Doc 3*, the passport is issued personally to the applicant. The applicant is either a citizen of the Russian Federation for whom the document was issued, or his legal representative (in relation to minors, incapacitated or partially capable persons).

That is, another person can pick up a passport only if he:

  • guardian of a person deprived or limited in legal capacity;
  • or parent/guardian of a child under 18 years of age.

However, they already submit documents on their behalf at the initial stage and fill out an application, that is, they are applicants, so it is quite logical that they will be given a document.

Moreover, the specialist who will issue the document must check the identity of the recipient with his photo in the application, a new foreign travel document and a regular internal passport, so be sure to take it with you.

Can I pick up my passport later?

People who cannot receive a document in person often wonder whether it is possible to pick up a passport later than the deadline.

The legislator is quite loyal in this regard. According to Article 177 of Doc 3*, passports that are not owned by the applicant are stored for 3 years from the date indicated in the “Date of Issue” column. After the specified period, they are destroyed.

On the next working day, information about this fact is entered into the departmental database of the Ministry of Internal Affairs of the Russian Federation “Mir”.

Information for comparison: in Ukraine, the shelf life of unclaimed foreign travel documents is 1 year.

In this case, the recipient will not have to pay any fines or storage services. Passports are stored at the competent authority free of charge.

Is it possible to pick up a passport in another city?

According to the rules, you need to receive a completed document from the authority where the application with the documents was submitted. Therefore, an attempt to come to any other department of the Ministry of Internal Affairs or center and demand the issuance of a foreign document will not be successful, since the finished document is stored in the body that issued it.

But you can still get it at a place other than your previous residence. For this, paragraph 174 Doc 3* provides the following procedure:

  1. The applicant applies to the Ministry of Internal Affairs at the place of current residence with a written application in any form.
  2. The body that accepted the application sends a request to the Ministry of Internal Affairs, which issued the passport.
  3. At the request of the unit at the applicant’s new address, the document is sent to the field communications or special communications.

This service is free - the recipient does not need to pay additional state fees.
