Having a residence permit for foreign citizens provides them with certain benefits and advantages. Although the procedure for obtaining this document is established by law and has a general procedure on the territory of the Russian Federation, each region has its own characteristics. It is most difficult for a foreigner to obtain a permanent residence permit in the capital of our country. “Residence permit”: general information

The procedure for obtaining a residence permit in Moscow
Article 8 of Federal Law No. 115 sets out the procedure for obtaining a residence permit. The document is issued only if you have a temporary residence permit and fulfill the requirements established by law.
Thus, to obtain a residence permit, you must fill out an application form in the prescribed form and prepare a package of documents. As for how to obtain a residence permit in Moscow, the procedure in this situation is carried out according to a similar algorithm, however, to obtain this document, it is necessary to confirm the fact of residence in the capital with the territorial migration service office and provide documentary evidence of the availability of living space for living.
A residence permit is issued for 5 years, but this period can be extended upon the application of a foreign citizen/stateless person, which must be submitted no later than 2 months before the expiration date of the document.
In addition, the residence permit can be extended many times at the request of interested parties.
It should be noted that a residence permit is provided in a special manner to the following persons:
- highly qualified specialists and their families;
- foreign citizens who have official status as native speakers of Russian;
- refugees;
- persons who have received temporary asylum;

- foreigners who are relatives of persons deported from the Crimean Autonomous Soviet Socialist Republic or are such persons themselves.
The registration procedure itself is not complicated, but it requires care and patience when preparing and submitting the documents required by law.
General provisions for registration
A residence permit in the Russian Federation is issued for a period of five years. That is, it remains valid for five years from the date of its receipt. The exception is for Russian speakers with confirmed status - their permit is valid for three years. The second exception with the same validity period of a residence permit is foreign specialists with a high level of professional training.
A residence permit differs from a temporary residence permit in that when the residence permit expires, it can be extended an unlimited number of times. Extension of a residence permit requires a special procedure.
For many foreigners, it is not entirely clear why to issue this document if it is more convenient and faster to issue a labor patent or temporary residence permit. Not everyone understands the conveniences and advantages that a residence permit in the Russian Federation provides to immigrants. Registration procedure and stages of receipt
Obtaining a residence permit is a very painstaking and time-consuming procedure. But if you meet all the necessary conditions for obtaining a permit, then in general the procedure will not be complicated by unnecessary actions. As mentioned earlier, initially it all starts with obtaining a temporary permit. Having received a temporary residence permit, an immigrant must take the following actions:
- receive a certificate of knowledge of the Russian language by first passing the appropriate exam. It is taken by everyone except citizens of Belarus, minors and pensioners;
- visit the Main Migration Department of the Ministry of Internal Affairs and fill out an application for a residence permit;
- in addition to all the papers, also submit a temporary residence permit;
- undergo a full medical examination, obtain all the necessary certificates indicating the absence of serious illnesses, serious infections, a negative test for the content of narcotic substances, the immunodeficiency virus, and others;
- confirm your legal income. To do this, prepare in advance personal income tax form-2, a bank account statement or a letter from the employer. The document must confirm the availability of earnings corresponding to the required subsistence level;
- if living in Russia for more than three years, provide a copy of a document indicating the availability of housing - personal, rented or relatives’ housing;
- after contacting the Main Directorate for Migration and Migration, pay a state fee of 3,500 rubles.
You don’t have to take the Russian language exam if you have proof of receiving at least an average education in the USSR (for example, a diploma of higher education) or in Russia, but after 1991. Copies of educational documents are submitted in a general package.
Simplified procedure
The simplified procedure involves the following features: an immigrant does not need to have a temporary permit before applying for a residence permit and to stay in the Russian Federation for at least one year at the time of applying to the Main Directorate for Migration. - copy and original identification document;
- four photographs. For stateless persons - two photographs;

- a highly qualified specialist must provide proof of employment - an employment contract (copy and original);
- documents for real estate owned (if any);
- the results of a medical examination, recorded in the form of certificates and conclusions. It is mandatory to provide certificates indicating the absence of dangerous diseases, infections and drug addiction;
- a certificate of knowledge of the Russian language, the theory of state and law, as well as the history of the Russian state, or a diploma of completed education in Russia (after 1991) or the USSR.
The list of documents and procedure are described for the standard case of obtaining a residence permit. The bodies of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs may additionally request, at their discretion, additional necessary documents or certificates. Or vice versa - request only part of the above papers.
A simplified scheme for obtaining a residence permit also involves marriage with a citizen of the Russian Federation. To do this, after marriage, according to current legislation, an immigrant must obtain a temporary permit (outside the required quotas) and live in Russia for at least one year. Then apply to the local department of the GUVM with originals and copies of the above documents, additionally providing the spouse’s passport (copy and original for verification) and marriage certificate.
State duty amount
Payment of the state fee when submitting documents for a residence permit is a mandatory stage.
A receipt for payment of the state fee is one of the required documents to be submitted. Among the payer's details, it is necessary to indicate exactly who the residence permit is being issued for. The state duty in 2021 is 3,500 Russian rubles. Payment can be made at any Russian bank or on the government services website. Application processing time
When all the necessary documents have been collected and submitted to the authorized body, all that remains is to wait for the application to be reviewed. The legislation provides for a period of no more than six months to consider the application and make an appropriate decision. The review period may be shortened depending on which category the applicant belongs to: for a highly qualified specialist, the review period will be up to three months, for political refugees - two weeks, citizens of Belarus will wait three months for a response, native Russian speakers - two months, participants of the state program for the resettlement of compatriots - two months.
Documents required to obtain a residence permit in Moscow
An exhaustive list of documents for obtaining a residence permit is established by Order of the Ministry of Internal Affairs of Russia dated November 9, 2021 No. 846.
You must prepare and submit the following to the migration authority at your place of residence in Moscow:
- application in the established form - in 2 copies;
- photographs – 4 pcs. (for stateless persons – 2 pcs.);
- identification document;
- documentary evidence that you have a legal income in Russia in the amount of at least the subsistence level (those who do not have an income in the specified amount must provide a pension certificate or other financial document);
- documentary evidence of the right to residential premises or to reside in it;
- certificate of absence of HIV infection, drug addiction and other infectious diseases;

For a number of persons from the categories indicated above, this list can be reduced or increased in accordance with Order of the Ministry of Internal Affairs of Russia No. 846.
Some of the above documents must be notarized, and copies of them must be attached to the application. After verification, the migration authority employee returns the originals to the applicant.

Responsibility for a minor child or incapacitated person lies with the official guardian (parent or representative). Deadlines and supporting documents
Foreigners are required to submit a completed notification form within 60 days from the date of expiration of the next validity period of the certificate. If the FMS fails to receive the document on time, the foreigner will face sanctions.
Additional documents may be required if annual confirmation of residence permit is carried out by parents of minor children or relatives of dependent pensioners. They need to attach a birth certificate and certificates confirming the fact of guardianship (if the fact of guardianship is justified).
How long does it take to consider an application for a residence permit in Moscow?

What are the consequences of ignoring the procedure for confirming a residence permit?
The law is very clear about the time limits for when notice must be given. If they are violated, a foreign citizen may face an administrative fine in the amount of 5-7 thousand rubles. or deprivation of a residence permit. The most common grounds for refusal to issue a residence permit in Moscow
An exhaustive list of grounds for refusal to issue a residence permit is established by Order of the Ministry of Internal Affairs of Russia No. 846:
- incorrectly completed application;
- presence of errors in personal data;
- provision of an incomplete set of documents (in addition to the application in electronic form through the State Services portal);
- the documents provided do not comply with legal requirements;
- the requirement for a 6-month period of residence from the date of receipt of the temporary residence permit has not been met;
- the period of residence in Moscow under a temporary residence permit is less than 6 months;
- the identification document is invalid or its validity expires in less than 6 months;
- illegal or in violation of the order of the applicant’s stay on the territory of the Russian Federation.

It should also be noted that a foreign citizen will not be able to obtain a residence permit for a number of reasons listed below:
- creating a threat to the state system of the Russian Federation;
- participation in terrorist organizations;
- deportation from the Russian Federation within 5 years before filing the application (or if within 10 years before filing the application such a person was repeatedly subjected to deportation/expulsion);
- providing false or forged documents;
- the presence of an unexpunged or outstanding conviction for serious / especially serious crimes, drug trafficking;
- bringing to justice more than twice during the year for violating public order and security, the procedure for the stay of foreign citizens in the territory of our country, for trafficking in narcotic drugs;
- inability to confirm your income, which should not be below the subsistence level, except in cases where this is permitted by law (disabled person, pensioner, minor, etc.);
- lack of legal grounds for residential premises after 3 years of stay in the Russian Federation;
- leaving the territory of the Russian Federation for permanent residence abroad;
- absence from the Russian Federation for more than 6 months in a row;

Documents for submitting confirmation of residence permit
When contacting the migration authorities and the Ministry of Internal Affairs, you must prepare a set of documents in advance.
What does it include?
- a copy of the citizen's passport;
- a reference document that should reflect the source of funds and their salary/amount. The salary must be sufficient for living. It must be no less than the minimum established size for the specific city where the foreigner lives;
- a certificate confirming that the foreign person has registered at his/her residence address;
- a notification document that confirms the applicant’s residence permit within the borders of our country;

When the validity of the next residence permit expires, employees of the migration service or the Ministry of Internal Affairs notify the foreign citizen in advance in writing of the impending need to confirm the residence permit.
In order for a foreign citizen to notify the authorities, it is necessary to clarify the address and work schedule of the department, then prepare the necessary documents for filing an application, which were listed in the previous section. After that, you need to fill out an application and carefully check it for errors.
You can come to the department yourself, or you can notify authorized persons using the postal service. With this option, the foreign citizen will give the package of documents to a Russian Post employee. In turn, the foreign citizen must be given a detachable part of the form with a note.

Income proof
The legislation of our country requires a foreign citizen, when obtaining a residence permit, to regularly confirm his intentions to remain in the country with an appropriate level of income. At the same time, the source of stable income must be legal.
Proof of income from a legal source can be presented in several documents. A foreigner has the right to choose any of the documents listed below and use it.
So, what will be the official confirmation?
- income certificate;
- copy of the tax return;
- bank statement from a personal account;
- another document confirming the level of income and its source.
The amount of money should allow a person to live in such a way that there is no need to turn to the state for help. An income level not lower than the subsistence minimum is considered sufficient.

The procedure for extending a residence permit in Moscow
Upon application of the person, the residence permit can be extended for 5 years. The extension procedure is similar to the procedure for obtaining a residence permit.
You can extend a residence permit in Moscow an unlimited number of times; to do this, you need to submit an application of the established form to the territorial department of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia (multifunctional migration center) in 1 copy no later than 2 months before the expiration of the document; if you miss the deadline for extending the residence permit, there will be denied.

Methods for submitting notifications about residence permits
A form confirming legal residence in Russia with a residence permit can be submitted to the migration authority in several ways - in person or by mail. The independent option is considered the most productive and safe, since it does not involve possible technical problems.

As already noted, notification of confirmation of residence is sent regardless of age. If a person is under 18 years of age, the action must be carried out by his legal representative - one of the parents or a guardian.
In this case, it is also necessary to attach a copy of the minor’s birth certificate and a copy of the guardianship decision (for guardians).
