Why do you need confirmation of a residence permit in the Russian Federation?

Having a residence permit for foreign citizens provides them with certain benefits and advantages. Although the procedure for obtaining this document is established by law and has a general procedure on the territory of the Russian Federation, each region has its own characteristics. It is most difficult for a foreigner to obtain a permanent residence permit in the capital of our country. Below we will talk about how to obtain a residence permit in Moscow; we will also look at the features of the procedure and current issues.

“Residence permit”: general information

The definition of the term “residence permit” is given in Article 2 of the Federal Law of July 25, 2002 No. 115-FZ “On the legal status of foreign citizens in the Russian Federation.” Thus, according to this norm, a residence permit (hereinafter referred to as a residence permit) is a document confirming the fact of permanent residence of a foreign citizen or stateless person on the territory of the Russian Federation. This document provides the right to persons who receive it to move freely across the border of our country, as well as the opportunity to receive additional tax benefits, banking services, social support from the state and other benefits.

In addition, in some cases, a residence permit acts as a universal document, since it is, for example, an identity document of a stateless person, that is, a stateless person.

It should also be noted that a residence permit is issued only on paper; an electronic version of this document is not provided for by law.

Annual procedure

annual confirmation

Until recently, there was no need to annually confirm your intentions to stay in the country and record the very fact of residence. However, after migration service employees noticed a growing tendency for foreign citizens to obtain a residence permit and then leave Russia, the authorities were forced to take legislative measures. Which resulted in an annual notification procedure.

If foreign citizens fail to fulfill their obligations, they face a fine or complete cancellation of the document. Amendments to the law came into force not long ago. Failure to notify the competent authorities in a timely manner threatens the visiting person with a payment of up to 7 thousand rubles . The most serious penalty involves complete revocation of the residence permit.

Notice deadlines

The Ministry of Internal Affairs requires a foreign citizen to notify the migration service or the Ministry of Internal Affairs within 2 months from the date of receipt of the visa the previous time.

Let's give an example. If you received a residence permit in July 2021, then you must notify the authorities of your intentions to continue living in the country no later than September 2020.

The procedure for obtaining a residence permit in Moscow

Article 8 of Federal Law No. 115 sets out the procedure for obtaining a residence permit. The document is issued only if you have a temporary residence permit and fulfill the requirements established by law.

Thus, to obtain a residence permit, you must fill out an application form in the prescribed form and prepare a package of documents. All this must be submitted to the territorial department of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia at least 6 months before the expiration of the temporary residence permit (TRP). This application can be submitted either in person or in the form of an electronic document via the Internet.

The main condition for obtaining a residence permit is to reside under a temporary residence permit in our country for at least 1 year.

As for how to obtain a residence permit in Moscow, the procedure in this situation is carried out according to a similar algorithm, however, to obtain this document, it is necessary to confirm the fact of residence in the capital with the territorial migration service office and provide documentary evidence of the availability of living space for living.

A residence permit is issued for 5 years, but this period can be extended upon the application of a foreign citizen/stateless person, which must be submitted no later than 2 months before the expiration date of the document.

In addition, the residence permit can be extended many times at the request of interested parties.

It should be noted that a residence permit is provided in a special manner to the following persons:

  • highly qualified specialists and their families;
  • foreign citizens who have official status as native speakers of Russian;
  • refugees;
  • persons who have received temporary asylum;
  • participants of the State Voluntary Resettlement Program;
  • foreigners who are relatives of persons deported from the Crimean Autonomous Soviet Socialist Republic or are such persons themselves.

The registration procedure itself is not complicated, but it requires care and patience when preparing and submitting the documents required by law.

General provisions for registration

A residence permit in the Russian Federation is issued for a period of five years. That is, it remains valid for five years from the date of its receipt. The exception is for Russian speakers with confirmed status - their permit is valid for three years. The second exception with the same validity period of a residence permit is foreign specialists with a high level of professional training.

A residence permit differs from a temporary residence permit in that when the residence permit expires, it can be extended an unlimited number of times. Extension of a residence permit requires a special procedure.

For many foreigners, it is not entirely clear why to issue this document if it is more convenient and faster to issue a labor patent or temporary residence permit. Not everyone understands the conveniences and advantages that a residence permit in the Russian Federation provides to immigrants. In this case, the rights of a resident with a registered visa are as follows:

  • the legal opportunity to live for a long time throughout the territory of the Russian Federation and change places of stay or residence at any time at one’s own request;
  • the opportunity to travel outside the borders of the Russian Federation without obtaining additional documents and also return freely;
  • the right to get a job in any organization without any restrictions;
  • foreign citizens who have issued a residence permit have the right to free social programs, medicine, education, and other social services;
  • a residence permit gives its holder the right to purchase residential premises, indicating them as his place of residence;
  • after receiving the status, a foreign person receives the right to elect and be elected to representatives of local authorities, to take part in referendums of local significance;
  • Having received a residence permit, a foreigner can apply for family members and relatives,
  • located in another country, invitation (call);
  • You can renew your status as many times as you like.

Getting a residence permit is a question of interest to many citizens of other countries. Russia is attracting more and more people who want to work, live and move around Russia without hindrance. Those who want their application for a residence permit to be approved by the Federal Migration Service must meet the following criteria:

  1. First, apply for a temporary residence permit and stay on the territory of the Russian Federation for at least a year after its registration.
  2. Prepare all documents necessary for preparing a residence permit.
  3. With the prepared documents, contact the Main Migration Department of the Ministry of Internal Affairs, where you will fill out an application for a residence permit and submit it.

In this way, an application for the right of residence occurs on a general basis. There are certain situations when it is possible to obtain the right of residence in a simplified, faster form.

In short, simplified registration involves filing an application for a residence permit only when a temporary residence permit has been received. It should be remembered that the submission of a package of documents for a residence permit on a general basis must occur no later than a year before the expiration of the temporary permit. Given the realities of bureaucratic delays, obtaining a residence permit may take a long time.

Registration procedure and stages of receipt

Obtaining a residence permit is a very painstaking and time-consuming procedure. But if you meet all the necessary conditions for obtaining a permit, then in general the procedure will not be complicated by unnecessary actions. As mentioned earlier, initially it all starts with obtaining a temporary permit. Having received a temporary residence permit, an immigrant must take the following actions:

  • receive a certificate of knowledge of the Russian language by first passing the appropriate exam. It is taken by everyone except citizens of Belarus, minors and pensioners;
  • visit the Main Migration Department of the Ministry of Internal Affairs and fill out an application for a residence permit;
  • in addition to all the papers, also submit a temporary residence permit;
  • undergo a full medical examination, obtain all the necessary certificates indicating the absence of serious illnesses, serious infections, a negative test for the content of narcotic substances, the immunodeficiency virus, and others;
  • confirm your legal income. To do this, prepare in advance personal income tax form-2, a bank account statement or a letter from the employer. The document must confirm the availability of earnings corresponding to the required subsistence level;
  • if living in Russia for more than three years, provide a copy of a document indicating the availability of housing - personal, rented or relatives’ housing;
  • after contacting the Main Directorate for Migration and Migration, pay a state fee of 3,500 rubles.

You don’t have to take the Russian language exam if you have proof of receiving at least an average education in the USSR (for example, a diploma of higher education) or in Russia, but after 1991. Copies of educational documents are submitted in a general package.

Simplified procedure

The simplified procedure involves the following features: an immigrant does not need to have a temporary permit before applying for a residence permit and to stay in the Russian Federation for at least one year at the time of applying to the Main Directorate for Migration. The following categories of persons can apply for the privileged right to obtain a residence permit in a simplified manner:

  • a highly qualified specialist, his family members and immediate relatives;
  • a simplified procedure is also provided for refugees;
  • native Russian speakers;
  • Citizens of Turkmenistan and Belarus can quickly obtain a residence permit;
  • marriage with a citizen of the Russian Federation.

For all of the above categories of citizens there is no need to obtain a temporary permit. You just need to prepare the following list of documents for a residence permit of the Russian Federation in 2018:

  • a correctly completed application for a permit. There should be two copies of it;
  • receipt for payment of state duty;
  • copy and original identification document;
  • four photographs. For stateless persons - two photographs;
  • documents confirming the immigrant’s legal earnings and solvency;
  • a highly qualified specialist must provide proof of employment - an employment contract (copy and original);
  • documents for real estate owned (if any);
  • the results of a medical examination, recorded in the form of certificates and conclusions. It is mandatory to provide certificates indicating the absence of dangerous diseases, infections and drug addiction;
  • a certificate of knowledge of the Russian language, the theory of state and law, as well as the history of the Russian state, or a diploma of completed education in Russia (after 1991) or the USSR.

The list of documents and procedure are described for the standard case of obtaining a residence permit. The bodies of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs may additionally request, at their discretion, additional necessary documents or certificates. Or vice versa - request only part of the above papers.

A simplified scheme for obtaining a residence permit also involves marriage with a citizen of the Russian Federation. To do this, after marriage, according to current legislation, an immigrant must obtain a temporary permit (outside the required quotas) and live in Russia for at least one year. Then apply to the local department of the GUVM with originals and copies of the above documents, additionally providing the spouse’s passport (copy and original for verification) and marriage certificate.

State duty amount

Payment of the state fee when submitting documents for a residence permit is a mandatory stage.
A receipt for payment of the state fee is one of the required documents to be submitted. Among the payer's details, it is necessary to indicate exactly who the residence permit is being issued for. The state duty in 2021 is 3,500 Russian rubles. Payment can be made at any Russian bank or on the government services website. On this site, only by specifying the correct details, you can transfer the required amount. Payment details must be found in the department of the Main Department of Migration Affairs where documents for a residence permit will be submitted. When renewing a residence permit after its expiration, the state fee is also paid again.

Application processing time

When all the necessary documents have been collected and submitted to the authorized body, all that remains is to wait for the application to be reviewed. The legislation provides for a period of no more than six months to consider the application and make an appropriate decision. The review period may be shortened depending on which category the applicant belongs to: for a highly qualified specialist, the review period will be up to three months, for political refugees - two weeks, citizens of Belarus will wait three months for a response, native Russian speakers - two months, participants of the state program for the resettlement of compatriots - two months.

  • statement (see below for details);

  • A certificate of no criminal record is not needed for visa-free foreigners.

The list varies depending on who is applying. For example, for participants in the state program for the resettlement of compatriots, the list of residence permits does not include a certificate of knowledge of the Russian language, legislation and history. Read below about the features for certain categories of foreign citizens.

If you are applying for a residence permit on the basis that your spouse has Russian citizenship, please note that the list of documents for a residence permit by marriage does not differ from the standard one. But it is necessary to attach a marriage certificate and the original passport of the spouse.

The cost of obtaining a residence permit in Moscow

In order to obtain a residence permit in Moscow, you must pay a state fee.

The amount of the state fee, in accordance with paragraphs. 18 clause 1 art. 333.28 of the Tax Code of the Russian Federation is 3,500 rubles, the same amount will have to be spent to renew the document.

The state fee is paid in advance, that is, before the residence permit is issued.

If you do not want to contact the migration department yourself, you can turn to intermediaries, however, the amount of remuneration for obtaining a residence permit in the capital significantly exceeds the amount of the state fee. The services of agents will cost you approximately 15 thousand rubles, plus the cost of paying state fees. The only advantage of this method is saving nerves and time. However, you should only contact trusted intermediary companies, otherwise you risk losing your money and not getting the desired result.

In what cases and who is obliged to notify

Notification of residence under a residence permit is submitted only by adult foreigners. Responsibility for a minor child or incapacitated person lies with the official guardian (parent or representative). The documents are sent to the migration service, which is responsible for issuing the residence permit.

If a migrant has changed his place of residence, he needs re-registration - the application is transferred to the new address. It is necessary to participate in the process even in cases where the foreigner does not have a specific place of residence at a particular time.

Which authority should I contact to obtain a residence permit in Moscow?

Where to get a residence permit in Moscow is one of the important questions that worries many foreigners who decide to settle in the capital. The most suitable way to solve this problem is to contact the State Services portal. In this case, you will need to send electronic copies of documents online and, at a time convenient for the applicant, come to an appointment at the territorial department of the Main Migration Department of the Ministry of Internal Affairs of Russia to further obtain a residence permit.

From November 7, 2021, all matters related to obtaining a residence permit in Moscow are handled only by the multifunctional migration center, which is located at the address: Moscow, pos. Voronovskoye, Varshavskoe highway, 64 km, house ownership 1, p. 47. The multifunctional migration center is open from Monday to Saturday. To submit documents, the center is open daily (except Sunday) from 8.00 to 20.00; you can receive documents on Monday, Tuesday and Thursday from 9.00 to 18.00 (Wednesday, Saturday and Sunday are closed days), on Friday - from 9.00 to 16.45.

Residence confirmation procedure

Notification of confirmation of residence is submitted only to the Federal Migration Service. There is an option to apply online through the state and municipal Internet portal. It is allowed to send a set of documentation at any post office. You must carry out the procedure yourself.

Confirmation by means of electronic communication is possible if the specific service center for foreigners has special equipment. There is no specific notice period required by federal law, but it is recommended that you do so as soon as possible.

Where to send a notification

The notification of confirmation of residence of a foreign citizen is a standard sheet, which includes two parts: for the applicant and for tear-off. One of the parts of the document is filled out in double-sided format. During the application process, the applicant must provide the following information:

  • full name of the migration authority;
  • last name and first name of the foreigner;
  • re-name of the department of the Main Department of Migration Affairs of the Ministry of Internal Affairs;
  • place of residence and postal code;
  • information about the place of employment for the last year - the dates of the conclusion of the employment contract or its termination are specified in detail;
  • information about all facts of crossing the state border;
  • passport series and number;
  • sources of income for 12 months;
  • information from the temporary residence permit and residence permit certificate;
  • the name of the documentation that is used to confirm official income;
  • signature.

The detachable part must be filled out at the FMS office. A special stamp is affixed to it. The form itself must be filled out strictly in Russian, by hand or on a personal computer. The correctness of the data is checked by a migration inspector or an employee of the Russian Post.

Deadlines and supporting documents

Foreigners are required to submit a completed notification form within 60 days from the date of expiration of the next validity period of the certificate. If the FMS fails to receive the document on time, the foreigner will face sanctions.

Additional documents may be required if annual confirmation of residence permit is carried out by parents of minor children or relatives of dependent pensioners. They need to attach a birth certificate and certificates confirming the fact of guardianship (if the fact of guardianship is justified).

How long does it take to consider an application for a residence permit in Moscow?

The period for consideration of an application for a residence permit is six months from the date of submission of the full package of documents. For some categories of foreign persons (see above), the period can be reduced to 3 months, sometimes up to 2 months.

An application for a residence permit is considered within 15 days for a foreign citizen:

  • whose citizenship of the Russian Federation has ceased for one reason or another;
  • who has been granted political asylum in our country.

For those who need to extend their residence permit, the period for reviewing the application is no more than 2 months.

What are the consequences of ignoring the procedure for confirming a residence permit?

The law is very clear about the time limits for when notice must be given. If they are violated, a foreign citizen may face an administrative fine in the amount of 5-7 thousand rubles. or deprivation of a residence permit. The last punishment provides for an order to leave the Russian Federation within 15 days from the date of the decision.

If the notification period has been violated and the residence permit has been cancelled, the migrant can restore it if there are good reasons for being late. The decision on the consequences of such an offense and the restoration of documents is made by the head of the territorial migration authority to which the foreign citizen is attached. To restore a residence permit, if there are valid reasons, you need to contact the Main Department of Migration of the Ministry of Internal Affairs with an application to cancel the decision and document the reasons why the deadlines were violated.

Documents for submitting confirmation of residence permit

documents for confirmation

When contacting the migration authorities and the Ministry of Internal Affairs, you must prepare a set of documents in advance.

What does it include?

  • a copy of the citizen's passport;
  • a reference document that should reflect the source of funds and their salary/amount. The salary must be sufficient for living. It must be no less than the minimum established size for the specific city where the foreigner lives;
  • a certificate confirming that the foreign person has registered at his/her residence address;
  • a notification document that confirms the applicant’s residence permit within the borders of our country;
  • directly a residence permit.

The application form is as follows: Application for residence permit_form

Such an application form can be obtained from the migration service employees.

When the validity of the next residence permit expires, employees of the migration service or the Ministry of Internal Affairs notify the foreign citizen in advance in writing of the impending need to confirm the residence permit.

In order for a foreign citizen to notify the authorities, it is necessary to clarify the address and work schedule of the department, then prepare the necessary documents for filing an application, which were listed in the previous section. After that, you need to fill out an application and carefully check it for errors.

You can come to the department yourself, or you can notify authorized persons using the postal service. With this option, the foreign citizen will give the package of documents to a Russian Post employee. In turn, the foreign citizen must be given a detachable part of the form with a note.

The detachable part will serve as proof of the fact that the foreign citizen timely submitted documents for confirmation of the residence permit.

Please note that you should not send the package of collected documents in the form of a registered letter.

It should also be taken into account that if a foreigner does not have a residence permit, but has a temporary residence permit, the above set of documents cannot be sent by mail. In this case, only personal appearance at the local territorial office of the Main Internal Affairs Directorate of the Ministry of Internal Affairs of Russia is allowed.

Income proof

The legislation of our country requires a foreign citizen, when obtaining a residence permit, to regularly confirm his intentions to remain in the country with an appropriate level of income. At the same time, the source of stable income must be legal.

Proof of income from a legal source can be presented in several documents. A foreigner has the right to choose any of the documents listed below and use it.

So, what will be the official confirmation?

  1. income certificate;
  2. copy of the tax return;
  3. bank statement from a personal account;
  4. another document confirming the level of income and its source.

The amount of money should allow a person to live in such a way that there is no need to turn to the state for help. An income level not lower than the subsistence minimum is considered sufficient.

According to official information for 2021, as of the first quarter for the Russian Federation as a whole, this amount is 9,909 rubles.

It should also be taken into account that the cost of living is divided into social categories. For example, citizens considered able to work have a slightly higher cost of living than children. Pensioners are the group with the lowest cost of living.

Among other things, in accordance with the laws of the Russian Federation, each of the constituent entities of the country, depending on the economic situation, has the right to establish its own level of living wage. It turns out that the cost of living may vary in different cities. Please take these features into account when filling out the residence permit form and other documents.

Notification of residence permit for a child of a foreign citizen

notification

Foreign citizens are also required to confirm a residence permit for their child with the relevant authorities. For children, such a notification is submitted to the local department of the Main Department of Internal Affairs of the Ministry of Internal Affairs by parents or official representatives of the children - guardians.

What needs to be submitted in the package of documents for a child?

  1. A photocopy of the birth certificate of a child of a foreign citizen;
  2. A document confirming guardianship or a passport of the parents, where information about the children is entered.

The procedure for extending a residence permit in Moscow

Upon application of the person, the residence permit can be extended for 5 years. The extension procedure is similar to the procedure for obtaining a residence permit.

You can extend a residence permit in Moscow an unlimited number of times; to do this, you need to submit an application of the established form to the territorial department of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia (multifunctional migration center) in 1 copy no later than 2 months before the expiration of the document; if you miss the deadline for extending the residence permit, there will be denied.

Before starting the procedure, you must pay a state fee of 3,500 rubles. The list of documents in this case is significantly smaller than when issuing a residence permit for the first time.

Methods for submitting notifications about residence permits

A form confirming legal residence in Russia with a residence permit can be submitted to the migration authority in several ways - in person or by mail. The independent option is considered the most productive and safe, since it does not involve possible technical problems.

The applicant only needs to prepare standard papers and take them to the territorial division of the Federal Migration Service or to the MFC. It is permitted to involve an outside official representative in the process. To do this, you need to prepare a standard notarized power of attorney.

Who must notify about residence in the Russian Federation under a residence permit and when to submit a notification

Every adult foreign citizen who has a permanent residence permit in Russia must carry out this procedure himself.

The first notification is submitted one year after receiving the residence permit. Then another year is counted down - and again the same actions. And so on until Russian citizenship is obtained or the residence permit is revoked.

The date of receipt of a residence permit is not the date of issue indicated in the document itself, but precisely the day when the citizen took it! That is, the date of issue and the date of receipt of the residence permit may differ.

Notification of confirmation of residence of a child of a foreign citizen

As already noted, notification of confirmation of residence is sent regardless of age. If a person is under 18 years of age, the action must be carried out by his legal representative - one of the parents or a guardian.

In this case, it is also necessary to attach a copy of the minor’s birth certificate and a copy of the guardianship decision (for guardians).
