What does a temporary residence permit give to citizens of Kazakhstan?

Having received a temporary residence permit, a citizen of Kazakhstan has the right to reside, work and do business in the Russian Federation for three years. Please note that the permit only allows you to work in the region of registration. After eight months, the migrant can apply for a residence permit. The end of 2021 brought impressive changes to the migration legislation of the Russian Federation. The list of grounds on which one can obtain a residence permit without a temporary residence permit has increased, and the grounds for a temporary residence permit have been revised. But, unfortunately, the hopes of foreign students were not justified: studying at local universities does not yet give the right to apply for temporary residence permits outside the quota. Moreover, studying does not even exempt you from the need to obtain a certificate of proficiency in Russian.

On the other hand, full-time study at a university already allows you to legally stay in the Russian Federation throughout the entire educational period, and the educational institution shares the responsibility for documents with the student.

RVP for students involves going through an absolutely standard procedure. Its first stage is submitting an application for a quota (if there is no reason to apply for a temporary residence permit without it). Then - collection and submission of all necessary papers.

The only benefit for foreign students with a temporary residence permit is the absence of the need to confirm income during the annual confirmation of residence . Who can receive a temporary residence permit without a quota?

At the end of each year, the country's government distributes quotas for migrants by region. There are a number of categories of citizens of Kazakhstan who do not need to receive a quota. These include:

• former citizens of the Soviet Union, whose place of birth is the RSFSR;
• persons recognized as incompetent, having children with Russian citizenship, or vice versa, children moving to incompetent parents, citizens of the Russian Federation;
• if the husband/wife has Russian citizenship;
• large investors;
• native Russian speakers;
• participants in the state program for the resettlement of compatriots.

If a foreigner is included in one of these groups, he can immediately apply for a temporary residence permit.

How to apply for a temporary residence permit

Every guest from the Republic of Kazakhstan who plans to stay legally in Russia over the next 3 years simply needs to obtain a TRP (temporary residence permit).

Since 2021, registration of temporary residence permits for citizens of Kazakhstan is carried out taking into account the quota or outside it.

Not all citizens have the right to registration without taking into account the quota, but only those who meet the following requirements:

1. They were born in the vastness of the former USSR and were citizens of this country.
2. They are recognized as incapacitated, but they have a child - a citizen of the Russian Federation.
3. Has disabled parents - citizens of the Russian Federation.
4. Are legally married to a citizen of the Russian Federation who has an official place of residence.
5. They serve in the army.
6. They have a child - a citizen of the Russian Federation over 18 years of age, recognized as incapacitated.

Do not forget that the number of quotas is limited; for example, only 2,000 permits were allocated for Moscow for 2021, so those who applied for a permit in the middle of the year have virtually no chance of receiving a quota.

What documents are needed for a temporary residence permit for citizens of Kazakhstan?

A temporary residence permit is issued on the basis of an application and a package of documents. You need to prepare the following:

• two copies of the application;
• two photos (35x45), without glasses, hats, the photo should be clear, not blurry;
• Kazakhstan passport with notarized translation;
• certificate of passing an exam in the Russian language, Russian history and law;
• migration card with registration mark;
• a quota or documentary evidence of the existence of grounds for obtaining a temporary residence permit without it;
• medical certificate and certificate of absence of HIV;
• receipt of payment of state duty.

All documents must comply with applicable legal requirements. If an applicant applies for a temporary residence permit based on kinship, but the citizens have different surnames, proof of kinship is required (marriage or birth certificate). Documents for a temporary residence permit for citizens of Kazakhstan without taking into account the quota include:

• certificate that the person was born on the territory of Russia;
• official registration of a participant in the resettlement program;
• documentary evidence of family ties with Russian citizens.

Important! Any documents issued in a language other than Russian must be translated, and the accuracy of the translation must be certified by a notary.

Issuance of a temporary residence permit to a citizen of Kazakhstan in the Russian Federation

The period for consideration and making a decision on issuing a temporary residence permit to citizens of Kazakhstan is no more than 60 days after submitting the application and a set of documents. In case of positive consideration of the issue, an official stamp is placed in the citizen’s internal passport. If a refusal is received, the foreign citizen may demand an explanation of the reason for such refusal. After a year, you can apply for a temporary residence permit again. Also, if the application is refused, the amount of the paid state fee is returned to the applicant.

On the Unified Portal of Public Services, you can draw up and submit an application for issuing a temporary residence permit. The applicant fills out the application form and sends it in real time, and all necessary documents are submitted upon receipt of the temporary residence permit. Notification of acceptance of the application will be sent to the applicant electronically.

On the official website of the Main Directorate for Migration, you can check the readiness of documents for a temporary residence permit by first filling out the online form. In addition, you can contact the branch where the application was submitted in person or by telephone.

How to correctly fill out an application for a temporary residence permit in Russia for Kazakhstanis?

The most important thing at the preparatory stage is drawing up an application form. If errors are made in filling out the data, this may be perceived as the submission of false data, so you need to pay maximum attention to this issue. Two identical copies are needed. You can fill it out manually or print it on your computer. It is unacceptable to shorten names and words, cross out what is written, or correct it. All questions must be answered in as much detail as possible and as much information provided as possible. You cannot skip columns, except for those about religion and nationality (this is optional).

If you encounter any difficulties in filling out the form, it is better to immediately seek help from the service center, which is located near almost every migration department of the Central Internal Affairs Directorate. They will provide qualified assistance; filling out takes an average of 15-30 minutes. In this case, the applicant can be sure that everything is filled out correctly, and mistakes made will not cause the documents to be returned or, even worse, will not lead to a negative decision on the application for a temporary residence permit.

The top part of the form is not filled out; this is the responsibility of the responsible person at the migration center. All questions in the questionnaire relate to the applicant’s personality: passport data, information about family, close relatives, work activity, education. It is mandatory to indicate the registration address in Russia.

The lower part of the application for a temporary residence permit for citizens of Kazakhstan is filled out in the presence of an inspector when submitting the document. The applicant confirms with his signature the correctness of completion and veracity of the submitted data. At the same time, the filing date is set, from which the countdown begins. The time for consideration of the application is determined by the legislation of the Russian Federation and is four months.

Registration of temporary residence permit for Kazakhstanis in Russia, procedure for obtaining

The procedure for obtaining a temporary residence permit for citizens of Kazakhstan will not differ in any way from the similar procedure provided for other CIS countries.

It will consist of several stages:

1. Collection of necessary documentation. It should be clarified that the specific list of documents will largely depend on what grounds the citizen provided for obtaining a temporary residence permit.
2. Submitting a completed application with a package of documents attached to it to the territorial offices of the Federal Migration Service.

Where to submit documents

All collected documents are submitted to the territorial division of the Federal Migration Service . You can submit documents either in person or by postal order. It is possible to submit an application through the State Services portal and the MFC.

However, experts recommend that foreigners personally contact the Federal Migration Service. State duty

The procedure for obtaining a permit is paid, and therefore, in addition to the costs of a notary and undergoing various medical checks, the applicant will need to pay a fee, the amount of which is 1,600 rubles.

Deadlines for registration and receipt

The Federal Migration Service takes up to 6 months to receive a radiopharmaceutical. This period is specified in legislative acts, however, most often the final decision becomes known to the applicant much earlier.

When can a citizen of Kazakhstan be refused a temporary residence permit?

The Russian state is loyal to its neighbors, so the list of simplifications is expanding every year. But there are still cases when citizens are refused a temporary residence permit. The most common reasons are:

• repeated administrative and migration violations, deportation;
• presence of an outstanding criminal record;
• providing false documents;
• participation in terrorist and anti-state activities;
• lack of legal sources of income.

A negative decision can be appealed within three days; resubmission of documents is possible only after a year.

Responsibilities of citizens of Kazakhstan after receiving a temporary residence permit

Particular attention should be paid to the fact that after receiving the coveted mark of legalization, the migrant must strictly comply with the obligations imposed by the legislation of the Russian Federation. Otherwise, non-compliance will have negative consequences, expressed in the cancellation of the permit, administrative fines and deportation from the country with a subsequent ban on entry.

Having received a status legalizing stay, a citizen of Kazakhstan is obliged to:

• do not change your place of residence at your own request;
• undergo a dactyloscopy procedure (give fingerprints);
• complete registration (within 7 days after issue);
• conduct official work and receive legal income;
• register with the tax service;
• do not leave the territory of the Russian Federation for more than 180 days a year.

In addition, annually a notification confirming residence (stay) in the country must be submitted to the Federal Migration Service of Russia. It must be accompanied by certificates about the source and amount of income for the past year. The notification is submitted in person or through the government services portal.

If a Kazakhstani citizen does not work during the reporting year or does not have a source of income sufficient to provide for himself and his family, the permit is revoked. Also, the basis for its cancellation is a violation of any of the obligations defined by law, or repeated (two or more times) administrative offenses committed in the Russian Federation.
