Please note: the migration center does not offer services for concluding fictitious marriages. Services are provided only if the foreigner has an official marriage with a Russian man (Russian woman).

In 2021, the number of foreigners wishing to legalize their presence in the Russian Federation is steadily growing, especially among those who arrived in Russia following their spouses or have been living and officially working in the Russian Federation for a long time.

What is a temporary residence permit? A temporary residence permit is an official document that gives a foreigner the right to stay and work legally for three years without obtaining a work patent in the region that issued the specified permit.

Please note: temporary residence permits cannot be extended. Upon completion, you must either obtain it again or request a residence permit.

Please note: all documents for a temporary residence permit must be legally prepared. The personal presence of the applicant when applying to the migration service (GUVM MIA) is mandatory.

Conditions for obtaining temporary residence permit for marriage

  • The marriage between domestic and foreign citizens must take place in accordance with the Law of the Russian Federation. To do this, the marriage must be registered either in a Russian registry office or in a foreign registry office, but in compliance with Russian laws on the legalization of marriage bonds;

If marriage takes place according to the laws of the state in which it will be formalized, then such a marriage will not have legal force on the territory of the Russian Federation.

  • The marriage certificate must contain a note indicating the legal nature of the process;
  • If a citizen of Russia and Ukraine decides to get married, then this process can be legalized in any domestic registry office;
  • If a citizen of Russia and a citizen of any other state get married, then it will be possible to get married only in the fourth Moscow registry office;
  • A Russian citizen who marries a foreigner is required to have a document confirming Russian citizenship;

Procedure for obtaining a temporary residence permit

In 2021, the requirements and list of certificates (both for visa-free and visa-free countries) for obtaining a temporary residence permit for marriage have changed several times.

Due to regular changes in the regulations on what needs to be done and prepared for the successful consideration of an application by the migration service and the issuance of a temporary residence permit, all consultations are carried out only in the office with a study of the situation and taking into account the latest changes.

The initial consultation on general issues of migration legislation is free of charge. Pre-registration for an appointment with a lawyer is required.

At the consultation, the issue of the possibility of acquiring a temporary residence permit on the basis of marriage, the conditions, procedure and terms for foreign citizens to acquire temporary residence are studied. The availability of the necessary certificates, certificates, etc. is checked.

Please note: each certificate, including translations, notarized copies, certificates must be properly prepared. The reasons for refusal are often related to incorrect registration.

The main advantage of being married to a citizen of the Russian Federation provided to a foreigner is the opportunity to contact the migration service and obtain a temporary residence permit without additional grounds.

Due to the fact that Ukraine and Russia have been in strained relations in recent years, this issue is of interest to many Ukrainians who want to move to the Russian Federation. So far, there are no new amendments or laws specifically regarding Ukrainians.

However, the Russian authorities promise in the future to gradually simplify the procedure for applying for a temporary residence permit for immigrants from Ukraine.

Documentation

The main list looks like this:

  • Passport with translation into Russian
  • Passport of the spouse – citizen of the Russian Federation
  • Marriage certificate
  • Birth certificate (if necessary)
  • Migration card and registration (MU)
  • Patent (if available)
  • Medical certificates
  • Certificate of knowledge of the Russian language and basic history (if necessary)
  • Certificate of no criminal record (if necessary)
  • Apartment use agreement (if necessary)

How can you cancel a temporary residence permit for marriage?

If it is possible to prove that the marriage is invalid. It can be done:

  • If the other spouse of the married couple shows up. This can happen if a citizen has not filed for divorce from his previous spouse. In this case, the “affected” person files a claim;
  • If employees of the Federal Migration Service suspect that the marriage has a “selfish” basis. For example, citizens of different countries decided to arrange a fictitious marriage in order to obtain a permanent residence permit in the future, etc.;

The procedure for obtaining a temporary residence permit for Turkish citizens

The procedure consists of the following steps:

  • collection of documents;
  • submission of collected papers for consideration;
  • wait for a response from the migration service after checking the data;
  • submit fingerprints after a positive response from the migration service;
  • register with the local migration service;
  • obtain a temporary residence permit;
  • put a mark on your identity card confirming receipt of the temporary residence permit.

The processing time for a submitted application depends on whether the applicant has a visa. If a Turkish citizen arrived on a visa, he will have to wait 6 months after submitting the application. If the order of arrival did not require a visa, then after 60 days the applicant will receive a response. Is it possible to re-register with a temporary residence permit due to marriage?

To change their place of residence, people living in Russia under a temporary residence permit, regardless of the grounds for obtaining it, must submit to the department of the Main Migration Department of the Ministry of Internal Affairs:

  • an arbitrarily drawn up statement;
  • identification;
  • RVP (in the form of a document or a special stamp in the passport);
  • documents confirming the existence of grounds for issuing a temporary residence permit.

The application is considered for 2 months, after which the migrant is sent a written response by mail. According to this decision, the foreigner is discharged from the previous address and registered at another.

List of documents for temporary residence permit for marriage

For citizens of a foreign country (except Ukraine), the following documents are required:

  • Two completed applications. A sample application form can be found freely available on the Internet or at the migration service;
  • Passport or other identification document. When changing the surname after marriage, instead of a passport, the citizen will have a temporary identity card + a photocopy of the passport;
  • Migrant Card;
  • Document with registration of temporary stay on the territory of the Russian Federation;
  • A document documenting the foreigner’s lack of criminal history, issued in the state from which the citizen arrived. The document must be drawn up no more than three months ago;
  • List of documents for a temporary residence permit
    Medical certificate confirming the completion of a medical examination and the absence of a list of diseases specified in the one hundred and eighty-eighth resolution of the Russian Federation. The certificate must be received no later than a month before submitting documents for a temporary permit;
  • Certificate of marriage with a Russian citizen;
  • Four photographs of 3.5 by 4.5 format;
  • If you have common children, two photographs of each of them of a similar format;
  • A document confirming knowledge of the Russian language;
  • A receipt confirming payment of the state duty. The cost of the service for 2021 is one thousand six hundred rubles;

If a citizen of another state is a Ukrainian (Ukrainian), then the list of documents looks like this:

  • Two completed applications. A sample application form can be found freely available on the Internet or at the migration service;
  • Passport or other identification document. When changing the surname after marriage, instead of a passport, the citizen will have a temporary identity card + a photocopy of the passport;
  • Two photographs (can be either color or black and white);
  • Certificate of marriage with a citizen of the Russian Federation;
  • A receipt confirming payment of the state duty. The cost of the service is specified in the migration service;

After submitting all the necessary documents to the federal migrant service, the citizen of Ukraine is left with only a medical commission.

For many foreign citizens, obtaining a quota is the only way to obtain a temporary residence permit. But there are always more people who want to become quota holders than there are quota places themselves. Therefore, failures here are a very common occurrence.

Previously, it was not clear what influenced the inspector’s decision. The migrants themselves said that receiving a quota is a lottery. Who's lucky?

But starting from 2021, the government has determined the criteria by which decisions on the allocation of quotas are made. The chances increase if the applicant has relatives with a residence permit or citizenship living in Russia. Having your own real estate in the Russian Federation, a job, or a sought-after profession will also make the difference in the direction of a positive decision.

If you were unable to get a quota

  1. Try again. The law allows you to submit an application an unlimited number of times. There is no need to wait any longer between submissions. Therefore, every time the acceptance of documents for a quota begins, bring an application. Some achieve their goal, if not the first time, then the second, third, or even tenth time.
  2. Serve in regions where the number of quotas increases from year to year. In such areas there is an outflow of people, so they are interested in attracting able-bodied foreigners. Compared to Moscow, it is easier to get a quota place in remote regions. For 2021, the number of places in the Far Eastern District and Southern Federal District has increased sharply. Having received permission there, you will be able to apply for a residence permit within six months. And with the acquisition of a residence permit, you will be free to move anywhere in Russia.

Documents for submission

  1. Application in 2 copies.
  2. Passport + its notarized translation.
  3. Your spouse's passport + copy of passport.
  4. Marriage certificate + copy.
  5. Birth certificate . They don’t always require it, sometimes they just warn you what will be required in the next stages, and sometimes they don’t accept documents without it, especially if you changed your last name and need to confirm it. + copy of birth certificate.
  6. Migration card + copy. If you extended the period of stay, then on the back of the migration card there should be a stamp indicating the extension of the period of stay.
  7. Migration registration + copy.
  8. Photo 2 pcs. 35x45 mm, matte. Read more about the requirements.
  9. Work permit or patent. You must have with you all receipts for payment of patents + photocopies of all documents provided. If you have a work record, it is also provided.
  10. Certificate of knowledge of the Russian language , Russian history and the fundamentals of Russian legislation. Or, if you confirm your knowledge of the Russian language with a diploma or certificate, then these documents + photocopies. Now you can take the exam immediately at the residence permit stage, and you can bring a certificate of language proficiency for a residence permit to submit a temporary residence permit, but this needs to be clarified, since it is not accepted everywhere.
  11. Medical certificates : honey. conclusion of a psychiatrist-narcologist, certificate of absence of HIV infections, medical conclusion about the absence of infectious diseases. Find out where the medical examination is held in your city directly from the district medical inspector from the inspector or at the stands. You only submit originals, so it’s best to make copies for yourself just in case. All certificates are valid for 3 months! Within 1 month after the documents are accepted, all medical certificates can be submitted (not everyone agrees and demands to be provided immediately), but if you are from a visa country, then the certificates definitely need to be brought along with the rest of the documents.
  12. TIN . They don’t always require it, but if you carry it, then + a copy.

If you are submitting documents together with your child:

  1. Child's birth certificate + copy. Or child’s passport + copy.
  2. Photo 2 pcs. 35x45 mm, matte.

If you are from a visa country, then provide additionally:

  • Certificate of no criminal record, valid for 3 months.

Restrictions for temporary residence permits for marriage with Russians

A migrant who has received a permit cannot leave for permanent residence outside the federal subject where it was issued. If a person is absent from his place of temporary registration for more than six months, the temporary residence permit is cancelled.

A temporary residence permit does not give a visitor all the rights of Russian citizens.

About the new law

On December 19, 2021, a draft amendment to the Federal Law dated July 25, 2002 No. 115-FZ “On the legal status of foreign citizens in the Russian Federation” was adopted.
According to these changes, if a foreign citizen submits documents on the basis of marriage with a citizen of the Russian Federation without taking into account the quota, then he must do this at the territorial migration authority where the spouse himself is registered at the place of residence. The law is effective from January 7, 2021.

What does this look like in practice? For example, Ivan, a citizen of Ukraine, married Anna. My wife has permanent registration in Voronezh, but she herself lives and works in the Moscow region. Previously, Ivan could apply for a temporary residence permit for marriage in the same Moscow region, but now the family needs to move to Voronezh and submit documents there, at the place of registration of the wife. In the future, Ivan will also have to live and work in Voronezh.

The procedure for registering a temporary residence permit without a quota: step-by-step instructions

The procedure for issuing a temporary residence permit is determined by the administrative regulations approved by Order of the Ministry of Internal Affairs of Russia dated November 27, 2017 No. 891 and is as follows.

  1. To obtain a temporary residence permit, you must fill out an application. The application form is an annex to the above administrative regulations
  2. Copies of documents must be attached to the application
  3. Before submitting the application, you must pay the state fee for the temporary residence permit.
  4. The applicant must submit an application in 2 copies for the issuance of a temporary residence permit to the migration department of the Ministry of Internal Affairs, to the diplomatic mission or consular office of the Russian Federation. The application can be submitted in the form of an electronic document through the Unified Portal
  5. If the application is submitted in person to the migration department, it is registered in the application register, and the applicant is issued a certificate of acceptance of the application
  6. After receiving and registering the application, it is subject to consideration
  7. During the consideration of the application, interdepartmental requests are generated and sent
  8. Based on the results of consideration of the application, a decision is made
  9. The applicant is notified of the decision made
  10. If the decision is positive, then the applicant is issued and issued a temporary residence permit.
