What is a residence permit
The abbreviation residence permit hides a permit to reside in the country, which is traditionally issued in the form of a document. Most often, a residence permit provides the migrant with almost all the rights that local residents have, with the exception of some. So, usually with this permit you can already work, get education, medical care, and enjoy social benefits.
What does a residence permit in Kazakhstan give to Russians?
The Central Asian republic is interested, first of all, in attracting foreigners who would help develop the state's economy and strengthen its position in the world market. Therefore, the authorities strictly control the number of migrants, hospitably accepting highly qualified specialists and wealthy visitors. The latter can contribute to the development of the economy by opening enterprises and creating jobs.
Registration of a residence permit for the implementation of commercial projects or employment will be sufficient. What preferences does a residence permit in Kazakhstan offer for Russians:
- unhindered stay in the country;
- legal employment;
- purchase of real estate.
Also, foreigners with a residence permit have the right to leave the Republic of Kazakhstan and return. There are only restrictions regarding the length of stay in other countries.
Kazakh residence permit – new rules
A residence permit is a document that allows the holder to live legally and permanently in the country that issued it. Until last year, residence permits in Kazakhstan were issued by migration police departments located at the migrant’s place of residence in the country. Before obtaining a residence permit, a foreign citizen applied for a permanent residence permit.
Certificate of registration of temporary stay
Recently, on December 4, 2015, the Minister of Internal Affairs of Kazakhstan approved new rules for issuing temporary and permanent residence permits. They came into force on February 29, 2021.
The rules listed in this order allow a foreigner, instead of two mandatory papers issued previously (permanent residence permit and residence permit), to receive a single document. This has reduced the number of procedures and reduced waiting times. Currently, a foreign citizen who wants to live legally in the Republic of Kazakhstan receives only a permanent residence permit.
Citizens of other states who permanently live outside of Kazakhstan, but wish to receive this document, submit a corresponding application to the consular offices of the Republic of Kazakhstan abroad.
Methods for obtaining a residence permit in Kazakhstan
It has been simplified to obtain a residence permit in Kazakhstan for people from the republic. Repatriates apply for it without any difficulties, just like people who have relatives in the Republic of Kazakhstan. For other foreigners, there are several ways to obtain a residence permit in Kazakhstan.
Starting a business
The World Bank (World Bank) included Kazakhstan in the TOP 20 countries that are the most attractive in the world for investors. This reputation is facilitated by the competent policy of the authorities, who in every possible way support wealthy foreigners so that they willingly make investments for the development of the economy.
Therefore, it will be enough to start a business by registering an enterprise in Kazakhstan in order to obtain a residence permit. Own company is the basis for a residence permit not only for a businessman, but also for his entire family.

If you find a place of employment and sign an agreement with an employer in the republic, you can collect documents for a residence permit. The chances of finding a decent job are higher if the foreigner is a doctor, teacher or oil worker. Since representatives of these professions are in demand in the local market.
Getting an education
You can submit documents to a Kazakh university. Upon enrollment in a higher education application, the student is entitled to a residence permit.
Marriage, family restoration
If a foreigner moves to the Republic of Kazakhstan to join his spouse, or when the newcomer’s parents live in this Central Asian state, he has every reason to apply for a residence permit. The same is true for persons who intend to start a family, choosing a citizen or citizen of Kazakhstan as their second half.
Options for obtaining a residence permit in the republic
In addition to temporary registration, there are several other ways to legally stay within the country.
Investment migration
Kazakhstan is a country with great development potential and significant reserves. For this reason, many foreign citizens want to open their own business in the country. Government authorities are gentle towards business and do not interfere with it, since a large influx of migrants from the business community contributes to the influx of investment capital into the economy of the state. The right to obtain a residence permit applies not only to a foreigner, but also to members of his family.
Registration of an enterprise takes place in state justice authorities, where a set of special documents must be provided. If you don’t have time to study the list and the rules for drawing up documents, then you can use the services of lawyers who will do all the red tape for the foreigner. In addition, experienced lawyers are able to negotiate with the instructions of local officials, not excluding corruption schemes.
Migration for work
The country lacks highly qualified personnel, since the majority of Russian-speaking residents of the republic find employment in Russia. Therefore, experienced qualified personnel are always in demand in Kazakhstan. The country is experiencing an acute shortage of personnel in the oil industry, educational and medical fields. The country does not experience a shortage of ordinary workers.
Studies
A diploma from a regional educational institution is not considered attractive. Therefore, students of the republic are trying to get the coveted degrees in educational institutions of other countries. This is explained by the fact that the educational sector in the republic is just beginning to develop. Russia is the leader in the influx of Kazakh students to receive education.
Despite all the sadness of the educational system of Kazakhstan, there is a student exchange program on its territory. The desire to study in educational institutions of the republic is of interest to students from African and Asian countries and Germany.
Marriage bond
You can easily obtain a residence permit in the republic, and later obtain citizenship of the country, in connection with marriage ties with a permanent resident of Kazakhstan. The process of concluding a marriage between a foreign entity and a resident of a republican power is regulated by state legislation.
What documents are required to obtain
To obtain a residence permit in Kazakhstan, you will need to collect a fairly extensive package of documents. Only the list will differ depending on which category the migrant belongs to.
For those who have a permanent residence visa
The public service is provided on the condition that the person has already received a B8 visa - “for permanent residence”. If you have such a document, you can contact the migration police with a minimum of documents on hand:
- passport (other identification document) with a B8 visa;
- 2 photos.
There are several requirements for photographs. They are made in size 3.5 by 4.5 cm. The person must look directly into the camera, that is, he is shown in the photo from the front.
Temporarily staying in Kazakhstan on another legal basis
If there is no TTV visa, this does not mean that it is impossible to obtain a residence permit. But in the absence of it, a residence permit in Kazakhstan for Russian citizens is provided on the basis of a much more substantial package of papers. It must include a statement. It is presented in the form of an application form, which is issued at the migration police department.
You also need to de-register in your home country in advance and receive a departure slip. Thus, the Russian confirms that the state allows him to travel abroad. Migrants from other countries will have to present an equivalent of such a permit. You will also need:
- autobiography;
- passport (other identity document);
- certificate of medical examination;
- document confirming financial solvency;
- certificate of criminal record/no criminal record.
There are a few exceptions to the rule. For example, ethnic Kazakhs and those persons who previously had the citizenship of the Republic of Kazakhstan do not have to live in solvency. An applicant with Kazakh roots who arrived from the PRC will not need a criminal record certificate.
Even in Kazakhstan, you need to take care of having a roof over your head. If you have the funds, you can buy housing by providing the appropriate title documents for the property. And if this is not possible, it will be enough to conclude an apartment rental agreement. Alternatively, obtain the consent of a local resident, who confirms in writing that he is ready to host a foreigner.
Requirements for documents required to obtain a residence permit
To obtain a residence permit in Kazakhstan, a Russian needs to prepare a standard package of documents:
- Permission to emigrate. As such permission, you can use a departure sheet issued on the territory of the Russian Federation, or a certificate confirming Russia’s consent to the move of its citizen to the Republic of Kazakhstan for permanent residence;
- Statement. The document form can be obtained from the Migration Service of Kazakhstan;
- Autobiography of the applicant. The document is provided in written form, there are no special requirements for its preparation;
- Certificate of health of the applicant;
- A foreign passport that has not expired;
- 2 photographs, established sample;
- A document confirming the financial stability of the applicant;
- Address certificate issued at the place of registration in the Republic of Kazakhstan.
The residence permit is issued for 10 years with the possibility of extension. An application for renewal of a document must be submitted 6 days before its expiration.
Result of the request
After submitting the documents, you just have to wait to see what decision will be made on them. There are two options for the outcome of the situation. Either a person receives a special plastic card - this is the form in which a modern residence permit for the Russian Federation is presented, or they send him a letter with a refusal, which must have objective reasons.
Deadlines for issuing a residence permit
The application is reviewed within 2 months. 60 calendar days are counted from the moment when a coupon is issued for acceptance of papers for consideration.
Use of a residence permit
While in the Republic of Kazakhstan, a foreign citizen provides a residence permit as a document proving his identity. When traveling to other countries, he uses his own passport.
Replacing or extending a residence permit
There are precedents when the residence permit has to be changed. You can apply for a new residence permit:
- if there has been a change in name (surname, patronymic);
- in case of change of citizenship;
- if a document is damaged and its data cannot be read, check its authenticity;
- in case of loss, expiration;
- if the legal status of the migrant has changed;
- after surgical gender reassignment.
The replacement of the document follows the same procedure as the original registration. Exactly the same requirements are put forward for the package of documents.
You can extend your residence permit in Kazakhstan by submitting an application 2 months before its expiration date or earlier. If the document is lost, the migrant must submit an appropriate application within the next three days.
When a decision is made to return to their homeland, a foreigner is faced with the question of how to apply for a residence permit in Kazakhstan. To do this, it is enough to submit an application to the migration police about your planned departure.

Obtaining a permanent residence permit in the Republic of Kazakhstan
Where should I apply for permission?
Permanent residence permits are issued to migration police units at the place of residence of the foreigner in Kazakhstan.
Who is issued a permanent residence permit?
In accordance with paragraph 6 of the State Standard, this service is provided to foreigners and stateless persons:
- having a visa category “permanent residence”;
- temporarily staying in the Republic of Kazakhstan on another legal basis (on the basis of visas, or on the basis of an agreement on visa-free entry and stay).
The internal affairs bodies do not accept documents from intermediary legal entities and individuals. Thus, to obtain a permit, a personal application to the migration police is required.
Documents required to obtain permission
In accordance with paragraph 11 of this Standard, to obtain permission it is necessary to submit:
1) foreigners who have a visa of the “permanent residence” category:
- a valid passport or document of a stateless person with a visa of the “permanent residence” category, which is issued by foreign agencies of the Republic of Kazakhstan and migration police units;
- two photographs measuring 35 x45 mm (the photograph must correspond to the age of the consumer and is taken strictly from the front on a light background, and the face should occupy about 75% of the total area of the photograph).
2) foreigners temporarily staying in the Republic of Kazakhstan on another legal basis:
- application form, the form of which is issued by employees of migration police units;
- written consent of the state of citizenship of the foreigner, which can be a departure certificate, or another document confirming permission to travel for permanent residence abroad;

- an official certificate of medical examination, which is issued by the health authorities of the Republic of Kazakhstan;
- a document confirming solvency during the period of stay in the Republic of Kazakhstan of the established form;

No document confirming solvency is required:
- persons born or previously held citizenship of the Republic of Kazakhstan or the Kazakh Soviet Socialist Republic, and members of their families;
- oralmans.
Is registration required in Kazakhstan before applying for a permit and for how long?
As stated above, permission is issued to foreigners and stateless persons who have a visa of the “permanent residence” category or are temporarily staying in the Republic of Kazakhstan on another legal basis (on the basis of visas, or on the basis of an agreement on visa-free entry and stay). Temporary stay on a legal basis presupposes registration of a foreigner within the established time limits at the place of residence. Therefore, a foreigner must undergo a temporary registration procedure before applying for a permit.
The registration period does not matter. It can be anything in accordance with the current rules.
Is it possible to obtain a permit without leaving your state for permanent residence?
Since we are talking about a permit for permanent residence in the Republic of Kazakhstan, the current rules, among other documents, provide for the foreigner to provide written consent from the state of citizenship of the foreigner (departure certificate or similar document) to travel for permanent residence abroad. Therefore, without deregistration and without permanently leaving your state for permanent residence, you cannot obtain a permanent residence permit in Kazakhstan.
Is it possible for a foreigner to travel outside the Republic of Kazakhstan during the period of obtaining a permit?
During the consideration of a foreigner's application for a permanent residence permit, he has the status of a temporarily staying foreigner. In accordance with paragraph 6 of the State Standard, this service is provided to foreigners and stateless persons who have a visa of the “permanent residence” category or are temporarily staying in the Republic of Kazakhstan on another legal basis.
According to Article 4 of the Law of the Republic of Kazakhstan “On the Legal Status of Foreigners,” foreigners are considered temporarily staying when they are on the territory of Kazakhstan. Thus, without being on the territory of the republic, a foreigner does not have the status of a temporary resident, and therefore there are no grounds for issuing him a permanent residence permit. Consequently, the absence of a foreigner in Kazakhstan may serve as a basis for refusal to issue a permanent residence permit.
What reasons justify a permanent residence permit?
The reasons why a foreigner wants to obtain a residence permit can be very different, for example, getting a job, studying, subsequent acquisition of citizenship, marriage, etc. The foreigner indicates these reasons when filling out the application.
Are there any benefits when obtaining a permit?
If the established formalities are completed and there are no grounds for refusal, any foreigner has the right to expect to receive a permit. However, many foreigners are interested in whether certain circumstances can make it easier to obtain a permit and residence permit? Among these circumstances are:
- the birth of a foreigner himself in Kazakhstan;
- previously held Kazakh citizenship;
- presence of close and distant relatives in Kazakhstan;
- birth of a child in Kazakhstan.
There are no special benefits for obtaining a residence permit. In themselves, the above circumstances do not make it easier to obtain permission, but they justify the reasons for permanent residence, so they should be indicated in applications accompanied by supporting documents. Some of these circumstances allow you not to prove your solvency, which will be discussed below.
Documents to be submitted in case of a positive decision
When making a positive decision on registration and issuance of a permanent residence permit in the Republic of Kazakhstan, the following is presented to the migration police unit:
- citizen registration book for housing in which the foreigner will be registered;
- a document confirming payment of the state fee for registration of place of residence in the amount of 10% of the MCI (subparagraph 1 of Article 540 of the Tax Code of the Republic of Kazakhstan);
- a completed arrival address sheet, the form of which is issued at the migration police departments;
- a completed statistical registration coupon for the arrival sheet, the form of which is issued at the migration police departments.
An employee of the migration police unit issues a document acceptance coupon.
Deadlines for issuing a permit
Clause 7 of this Standard specifies the period for completing the service from the moment of submitting the necessary documents and receiving a coupon for accepting the application - 60 calendar days.
Result of applying for a permanent residence permit
The result of the application is the affixing of a registration stamp in the citizen registration book, as well as in the certificates of stateless persons, or a reasoned response about the refusal to issue a permit.
Refusal to issue and cancellation of a previously issued permanent residence permit
The list of grounds for refusal to issue a permanent residence permit is established by Article 49 of the Law of the Republic of Kazakhstan “On Population Migration”.
The issuance of a permit may be refused or a previously issued permit may be cancelled:
- obviously illegal migrants, as well as persons prosecuted for committing crimes under the laws of the countries from which they come;
- persons released from places of imprisonment whose permanent place of residence before conviction was outside the Republic of Kazakhstan;
- persons who have committed crimes against humanity;
- persons, with the exception of oralmans, persons born or previously held citizenship of the Republic of Kazakhstan or the Kazakh Soviet Socialist Republic, and members of their families, who have not provided confirmation of their solvency in the prescribed manner;
- persons who have a disease that may cause an epidemic on the territory of the Republic of Kazakhstan in accordance with the conclusion of the health authorities;
- persons who have violated the legislation on the legal status of foreigners, on the basis of a decision of the authorized body, the National Security Committee;
- persons inciting interstate, interethnic and religious hatred;
- persons whose actions are aimed at violent change of the constitutional order;
- persons opposing the sovereignty and independence of the Republic of Kazakhstan, calling for the violation of the unity and integrity of its territory;
- persons with a criminal record for terrorist activities, a serious or especially serious crime. In this case, the severity of the crime, the presence or absence of a criminal record are determined by the laws of the Republic of Kazakhstan;
- persons who provided false information about themselves when applying for a permanent residence permit in the Republic of Kazakhstan or who, without good reason, did not submit the necessary documents within the time limits established by law;
- persons previously expelled from the Republic of Kazakhstan;
- if this is necessary to protect the rights and legitimate interests of citizens of the Republic of Kazakhstan and other persons.
The refusal may be appealed in court.
Confirmation of solvency
In accordance with Article 4 of the Law “On the Legal Status of Foreigners”, a mandatory condition for granting a permanent residence permit in the Republic of Kazakhstan is confirmation by the person applying for such a permit.
According to paragraph 2 of the Rules for confirmation by foreigners and stateless persons applying for permanent residence permits in the Republic of Kazakhstan, their solvency during their stay in the Republic of Kazakhstan, the applicant submits to the internal affairs bodies a document from a resident bank of the Republic of Kazakhstan (certificate), signed by the chairman of the bank’s board or an authorized person of the bank, about the availability of money in the bank account (accounts) in the amount of:
- equal to or exceeding the equivalent of 1320 times the minimum calculation index (MCI) established on the date of filing the application for permanent residence;
- sufficient to purchase a home, based on 15 square meters per family member in the locality where the applicant intends to live.
The first part of the specified amount is necessary to confirm the availability of funds necessary for a foreigner to live in Kazakhstan.
The second part of the specified amount is necessary to confirm the foreigner’s ability to provide himself with housing. The amount of this amount is determined in accordance with the average market value of housing in a given locality on the basis of a document issued by the relevant authorized body that registers rights to real estate and transactions with it (the justice body). If there is an agreement with an individual or legal entity to provide the applicant with housing (a rental agreement), a bank document confirming the availability of money to purchase the housing is not required. In this case, only confirmation is required in the amount of 1320 MCI.
Submitted documents confirming solvency are checked by internal affairs bodies for authenticity and are attached to the materials for obtaining a permit.
Should each family member prove their solvency?
If several family members apply for a permanent residence permit, then everyone must confirm the availability of an amount of 1320 MCI. who has reached the age of 16. In the absence of a home, confirmation of the availability of an amount sufficient to purchase it is presented at the rate of 15 square meters for each family member of any age.
Who is not subject to the requirement to prove solvency?
You do not have to prove your solvency:
- oralmans;
- persons born or previously held citizenship of the Republic of Kazakhstan or the Kazakh Soviet Socialist Republic, and members of their families;
- citizens of countries with which Kazakhstan has agreements on a simplified procedure for acquiring citizenship (Belarus, Kyrgyzstan, Russia, Ukraine), due to the fact that they have the right to apply for citizenship of the Republic of Kazakhstan immediately upon arrival in the country (Letter from the Migration Police Department of the Ministry of Internal Affairs Affairs of the Republic of Kazakhstan dated February 6, 2004 N 20/4-526).
