  • two photographs measuring 35 x45 mm (the photograph must correspond to the age of the consumer and is taken strictly from the front on a light background, and the face should occupy about 75% of the total area of ​​the photograph).
2) foreigners temporarily staying in the Republic of Kazakhstan on another legal basis:
  • application form, the form of which is issued by employees of migration police units;
  • written consent of the state of citizenship of the foreigner, which can be a departure certificate, or another document confirming permission to travel for permanent residence abroad;
  • autobiography, which is compiled by the consumer in any form;
  • a valid passport or document of a stateless person;
  • an official certificate of medical examination, which is issued by the health authorities of the Republic of Kazakhstan;
  • a document confirming solvency during the period of stay in the Republic of Kazakhstan of the established form;
  • two photographs measuring 35 x45 mm (the photograph must correspond to the age of the consumer and is taken strictly from the front on a light background, and the face should occupy about 75% of the total area of ​​the photograph).

No document confirming solvency is required:

  • persons born or previously held citizenship of the Republic of Kazakhstan or the Kazakh Soviet Socialist Republic, and members of their families;
  • oralmans.
Is registration required in Kazakhstan before applying for a permit and for how long?

Documents to be submitted in case of a positive decision

When making a positive decision on registration and issuance of a permanent residence permit in the Republic of Kazakhstan, the following is presented to the migration police unit:

  • citizen registration book for housing in which the foreigner will be registered;

Refusal to issue and cancellation of a previously issued permanent residence permit

The list of grounds for refusal to issue a permanent residence permit is established by Article 49 of the Law of the Republic of Kazakhstan “On Population Migration”.

The issuance of a permit may be refused or a previously issued permit may be cancelled:

  • obviously illegal migrants, as well as persons prosecuted for committing crimes under the laws of the countries from which they come;
  • persons released from places of imprisonment whose permanent place of residence before conviction was outside the Republic of Kazakhstan;

  • persons who have violated the legislation on the legal status of foreigners, on the basis of a decision of the authorized body, the National Security Committee;
  • persons inciting interstate, interethnic and religious hatred;
  • persons whose actions are aimed at violent change of the constitutional order;
  • persons opposing the sovereignty and independence of the Republic of Kazakhstan, calling for the violation of the unity and integrity of its territory;
  • persons with a criminal record for terrorist activities, a serious or especially serious crime. In this case, the severity of the crime, the presence or absence of a criminal record are determined by the laws of the Republic of Kazakhstan;
  • persons who provided false information about themselves when applying for a permanent residence permit in the Republic of Kazakhstan or who, without good reason, did not submit the necessary documents within the time limits established by law;
  • persons previously expelled from the Republic of Kazakhstan;
  • if this is necessary to protect the rights and legitimate interests of citizens of the Republic of Kazakhstan and other persons.

The refusal may be appealed in court.

Confirmation of solvency

In accordance with Article 4 of the Law “On the Legal Status of Foreigners”, a mandatory condition for granting a permanent residence permit in the Republic of Kazakhstan is confirmation by the person applying for such a permit.

According to paragraph 2 of the Rules for confirmation by foreigners and stateless persons applying for permanent residence permits in the Republic of Kazakhstan, their solvency during their stay in the Republic of Kazakhstan, the applicant submits to the internal affairs bodies a document from a resident bank of the Republic of Kazakhstan (certificate), signed by the chairman of the bank’s board or an authorized person of the bank, about the availability of money in the bank account (accounts) in the amount of:

  • equal to or exceeding the equivalent of 1320 times the minimum calculation index (MCI) established on the date of filing the application for permanent residence;
  • sufficient to purchase a home, based on 15 square meters per family member in the locality where the applicant intends to live.

The first part of the specified amount is necessary to confirm the availability of funds necessary for a foreigner to live in Kazakhstan.

The second part of the specified amount is necessary to confirm the foreigner’s ability to provide himself with housing. The amount of this amount is determined in accordance with the average market value of housing in a given locality on the basis of a document issued by the relevant authorized body that registers rights to real estate and transactions with it (the justice body). If there is an agreement with an individual or legal entity to provide the applicant with housing (a rental agreement), a bank document confirming the availability of money to purchase the housing is not required. In this case, only confirmation is required in the amount of 1320 MCI.

Submitted documents confirming solvency are checked by internal affairs bodies for authenticity and are attached to the materials for obtaining a permit.

Should each family member prove their solvency?

If several family members apply for a permanent residence permit, then everyone must confirm the availability of an amount of 1320 MCI. who has reached the age of 16. In the absence of a home, confirmation of the availability of an amount sufficient to purchase it is presented at the rate of 15 square meters for each family member of any age.

Who is not subject to the requirement to prove solvency?

You do not have to prove your solvency:

  • oralmans;

Deadlines for issuing a residence permit

In accordance with paragraph 7 of this Standard, the issuance period from the moment of submitting the above necessary documents and receiving the application counterfoil of Form 1 (F-1) of the established form until the issuance of a residence permit should not exceed 60 calendar days.

Refusal to issue a residence permit

The grounds for refusal to issue a residence permit in accordance with paragraph 17 of this Standard are:

  • availability of a valid residence permit in the Republic of Kazakhstan for a foreigner in the name of the applicant;
  • expiration of the foreigner’s national passport, or if less than 2 months remain before its expiration.

Validity of the residence permit and its extension

In accordance with paragraph 8 of the Rules for Documenting the Population of the Republic of Kazakhstan, a residence permit is issued for a period of validity of 10 years, but not longer than the validity period of the passport of the foreigner’s country of citizenship.

Applications to extend the validity of an existing document or to issue a new document for the right to reside in the Republic of Kazakhstan must be submitted by foreigners to the internal affairs bodies at their place of residence no later than 2 months before its expiration, and in case of loss - no later than three days (clause 2 Rules).

During the period of registration of a new residence permit, a foreigner does not lose his status as a permanent resident in Kazakhstan.

Replacement of residence permit

In accordance with paragraph 1 of Article 22 of the Law of the Republic of Kazakhstan “On Identity Documents”, a residence permit is subject to replacement in the following cases:

  • changes in last name, first name, patronymic (if any), citizenship;
  • expiration of its validity period;
  • impossibility of identifying the owner’s data or the degree of document protection;
  • loss of the document from the date the owner submitted the application to the authorized state body;
  • inconsistency with the legal status of the owner;
  • gender change.

Responsibility for living without a residence permit or with an expired residence permit

Part 3 of Article 377 of the Code of the Republic of Kazakhstan on Administrative Offenses establishes administrative liability for permanent residence in the Republic of Kazakhstan of a foreigner or stateless person without a residence permit or without a stateless person’s certificate or with an invalid residence permit, stateless person’s certificate for a period of more than 10 calendar days , as well as untimely notification of internal affairs bodies about the loss of a passport, residence permit or identity card of a stateless person.
