  • notarized written consent of children aged 14 to 18 years.

Grounds for loss of citizenship of the Republic of Kazakhstan

Loss of citizenship of the Republic of Kazakhstan is possible without an application from a resident of the country. The most common reasons according to the law are:

  • entry into military service or government agencies of foreign powers;
  • providing false information when registering citizenship and obtaining a passport;
  • residence outside the country for more than three years, provided that the citizen was not registered with the consulate all this time;
  • acquisition of foreign citizenship;
  • international agreements.

It is worth noting that living outside of Kazakhstan is not a reason for denying citizenship to a person if all the rules and requirements of the law are met. The decision on the loss of Kazakh citizenship by a certain person is made by the Ministry of Internal Affairs or the Ministry of Foreign Affairs of the country. Registration of exit is carried out only after the person is notified of the decision made. If a citizen who has lost his status wants to take on the citizenship of another power, he is required to provide a certificate of loss of the status of the Republic of Kazakhstan. Renunciation of citizenship of citizens who do not live on the territory of the Republic of Kazakhstan

Those people who live outside the state can also apply to renounce their citizenship. Permanent residence in another country does not lead to the termination of Kazakhstani citizenship, unless the person has violated the law and conditions of residence abroad.

Citizens of the Republic of Kazakhstan who temporarily reside in Russia must submit an application to renounce Kazakhstani citizenship in Omsk or for registration in the territory of the Republic of Kazakhstan. All prepared documents for renunciation of Kazakhstani citizenship must be submitted in person or by notarized power of attorney through a representative. After acquiring citizenship of another state, you need to submit an identity card issued by the Republic of Kazakhstan to the consulate.

Certificate of renunciation of citizenship

Obtaining a Russian passport will require a certificate of loss of Kazakh citizenship. You will need to obtain it from the republic's police department, consulate or diplomatic mission. For this purpose, the applicant applies to the relevant institution with the following documents:

Time limit for consideration of case materials

The processing time for materials in a case on renunciation of citizenship is about six months (one month for each government agency through which the documents are processed). Within seven days, the Ministry of Internal Affairs informs the migration police about the renunciation of citizenship by a certain person. The police department must notify the results of consideration of the application within the next seven days. After which the Ministry of Foreign Affairs is obliged to notify the consulate within two weeks and transfer the case materials. A parent or his official guardian submits a waiver of citizenship of the Republic of Kazakhstan on behalf of a child. If the person’s second parent does not renounce their former status, then the child can remain a Kazakh citizen. In order for a child to renounce citizenship, both parents submit a request to renounce citizenship on behalf of the child to the authorized bodies.

If the child’s age is from 14 to 18 years, an additional notarized consent of the person to withdraw from Kazakhstan status is submitted.

A child whose parents have been deprived of parental rights does not need the consent or request of the parents when renouncing citizenship. If parents deprived of parental rights renounce their status, the child remains a citizen of the Republic of Kazakhstan.

Obtaining citizenship of the Russian Federation

To obtain Russian citizenship, Kazakh citizens must submit an application for admission to Russian citizenship at the Russian Consulate office on the territory of the Republic of Kazakhstan. If a Kazakh did not report the acquisition of a foreign passport and did not submit papers on refusal, he is subject to a fine in the amount of 50 to 300 minimum wages and forced deprivation of status.

A ban on restoration of citizenship for 5 years applies to all persons who voluntarily renounced citizenship and who were forcibly deprived of their status due to having a second citizenship. Cancellation of renunciation is not possible if the applicant has already received a decision and the corresponding certificate. Exit is also possible if a Kazakh is planning to move for permanent residence abroad or find a job abroad.

To remain in the Republic of Kazakhstan after renouncing their previous status, a stateless person issues a residence permit, and a foreigner receives a departure certificate, leaves the country to obtain citizenship of another state, returns to the Republic of Kazakhstan and issues a residence permit as a citizen of another state. However, leaving the status is not necessarily accompanied by receiving a departure certificate. If the applicant does not plan to leave the Republic of Kazakhstan after completing the procedure, he does not need a departure certificate.
